Common use of Off Duty Court Clause in Contracts

Off Duty Court. Supervisors required to appear off-duty in any court or hearing as a witness for the prosecution or defense, except for personal involvement, shall be paid as follows: A. Supervisors shall be paid at one and one half (1-1/2) times the supervisor’s premium rate of pay for a minimum of two (2) hours. B. Subsequent court or hearing attendance time shall be paid at one and one-half (1- 1/2) times the supervisor's premium rate of pay. C. Duces tecum subpoenas shall be paid an additional two hours at one and one-half (1-1/12) times the supervisor's premium rate of pay. D. In any event, the supervisor shall not be paid twice for the same hours. All witness fees shall be returned to the City. Supervisors must turn in their subpoena with a DA’s representative signature and have the start and end times of their court appearance written on the subpoena in order to receive court pay. Subpoenas must be turned in within the same pay period of the court appearance date.
