Offer of Gratuities. The MCO warrants that it has not employed any company or person other than a bona fide employee working solely for the MCO or a company regularly employed as its marketing agent to solicit or secure the Contract and that it has not paid or agreed to pay any company or person any fee, commission, percentage, brokerage fee, gifts, or any other consideration contingent upon or resulting from the award of the Contract. For breach or violation of this warranty, the Department will have the right to terminate this Contract with a thirty (30) calendar day notice without liability or, at its discretion to pursue any other remedies available under this Contract or by law.
Offer of Gratuities. The Contractor certifies that no Enrollee of Congress, nor any elected or appointed official, employee or agent of the State of Mississippi, DHHS, CMS, or any other federal agency, has or will benefit financially or materially from this contract. This Contract will be terminated by the Division if it is determined that gratuities of any kind were offered to or received by any of the aforementioned officials or employees from the Contractor, its agents, employees, subcontractors or suppliers.
Offer of Gratuities. By signing this agreement, the Health Plan signifies that no member of, or a delegate of, Congress, nor any elected or appointed official or employee of the State of Florida, the Government Accountability Office, DHHS, CMS, or any other federal agency has or shall benefit financially or materially from this procurement. This Contract may be terminated by the Agency if it is determined that gratuities of any kind were offered to, or received by, any officials or employees from the state, its agents, or employees.
Offer of Gratuities. The MCO, its agents and employees, certify that no elected or appointed official or employee of the DEPARTMENT has or will benefit financially or materially from this contract. The contract may be terminated by the DEPARTMENT if it is determined that gratuities of any kind were either offered to or received by any of the aforementioned officials or employees of the MCO, its agent or employee.

By its agreement to the terms of this contract, the Contractor certifies that no elected or appointed official or employee of the State of Connecticut has or will benefit financially or materially from this contract. The Department may terminate this contract if it is determined that gratuities of any kind were either offered or received by any of the aforementioned officials or employees from the Contractor or its agents or employees. The contractor agrees to disclose to the Commissioner of the Department of Children and Families any items of value provided to DCF employees for which full payment has not been made.

The Contractor warrants, represents, and certifies that no elected or appointed official or employee of the State of Connecticut has, or agrees to, benefit financially or materially from this procurement. This Agreement may be terminated by the Administrator without liability attaching to the Administrator if it is determined that gratuities of any kind were either offered to, or received by, any of the aforementioned officials or employees from the Contractor, or any of its agents, representatives or employees.
Offer of Gratuities. By signing this contract, the Contractor signifies that no member of or a delegate of Congress, nor any elected or appointed official or employee of the State of Tennessee, the federal General Accounting Office, federal Department of Health and Human Services, the Center for Medicare and Medicaid Services, or any other state or federal agency has or will benefit financially or materially from this Contract. This Contract may be terminated by TennCare as provided in Section D.6, if it is determined that gratuities of any kind were offered to or received by any of the aforementioned officials or employees from the Contractor, its agent, or employees.

By signing this agreement, the PDHP signifies that no member of or a delegate of Congress, nor any elected or appointed official or employee of the State of Florida, the General Accounting Office, the Department of Health and Human Services, CMS, or any other federal agency has or shall benefit financially or materially from this contract. The contract may be terminated by the Agency if it is determined that gratuities of any kind were offered to or received by any officials or employees from the offerer, his agent, or employees.
Offer of Gratuities. The Contractor shall represent and certify that no elected or appointed official or employee of the State has or will benefit financially or materially from the Agreement. The Agreement may be terminated by the State if it is determined that gratuities of any kind were either offered to or received by any of the aforementioned officials or employees from the Contractor, the Contractor’s agent(s), representative(s) or employee(s).

ATTORNEYS' FEES In the event of a dispute, each party to the contract will be responsible for its own attorney's fees except as otherwise provided by law. VENUE OR COURT OF JURISDICTION
