Common use of On-Site Clause in Contracts

On-Site. At all times that Supplier is at any facility of Buyer and in addition to Supplier's own safety requirements, Supplier acknowledges and agrees to comply with Xxxxx's safety requirements and shall ensure that all of Supplier's employees, subcontractors and agents doing work on the site are familiar with Xxxxx’s rules and requirements at any such facility and comply with them. In addition to the safety and health provisions contained in Buyer’s policies and safety requirements, Supplier while performing the Services hereunder, shall abide by any and all of Supplier's, as well as OSHA's, safety and health rules and shall provide Buyer with a copy of all accident reports prepared by or submitted to Supplier, including but not limited to all OSHA illness and injury reports. Supplier hereby acknowledges and agrees that it and any of its subcontractors have read such rules and will abide by them. All Services performed hereunder shall fully comply with all applicable governmental safety and health requirements, including but not limited to the rules and standards established by the Occupational Safety and Health Act of 1970, as amended, and any other applicable federal, state and/or local safety or health laws, rules or regulations. Any equipment provided by Buyer to Supplier for the benefit of Supplier's employees or those of its subcontractors shall be provided on an "as is" basis with no warranty of performance and at the sole risk and liability of Supplier to ensure that such equipment is fit for the use intended and in proper working order. Supplier has a duty to inspect the equipment prior to use, and agrees to defend, indemnify, and hold harmless Buyer from any and all claims, losses or expenses (including reasonable attorneys’ fees) of Supplier, its subcontractors, and all of their respective employees arising out of the use of any equipment furnished by Buyer or advice given by Buyer relating to such equipment to the fullest extent allowed by law. Supplier shall maintain a drug and alcohol free work force at all times while on Supplier's premises. Supplier represents and warrants that all of Supplier’s employees and subcontractors performing Services at Buyer’s site shall have successfully passed an eleven (11) panel drug screen, as permitted by law, and a background check including a seven (7) year criminal history search. The results of the background check shall be made available to Buyer’s Human Resources representative upon request. A valid TWIC card and additional background check requirements may be requested for any sites specified by Buyer. Supplier acknowledges that it has examined and is familiar with the premises upon which the Services is to be performed and knows the location, the areas that will be assigned to it for its use, the configuration of the ground, the difficulties and potential hazards attending the execution of Services, the general and local labor conditions and all other matters which can in any way affect the execution or safety of the Services. Supplier shall perform the Services and supply the Materials in such a manner as to cause a minimum of interference with Xxxxx's operations and the operations of other contractors on Buyer's premises. Upon completion of Services and provisions of Material, Supplier shall restore the premises to its original condition and leave said premises clean and free of all tools, equipment, waste materials, and rubbish.

On-Site. At all times that Supplier is Supplier’s employees, subcontractors or agents are at any facility site of Buyer Buyer, and in addition to Supplier's ’s own safety requirements, Supplier acknowledges and agrees to comply with Xxxxx's ’s safety requirements and shall ensure that all of Supplier's ’s employees, subcontractors and agents doing work on the site are familiar and comply with XxxxxBuyer’s rules and requirements at any such facility and comply with themsite. In addition to the safety and health provisions contained in Buyer’s policies and safety requirements, Supplier while performing the Services hereunder, shall abide by any and all of Supplier's’s, as well as those established by the Occupational Safety Health Act of 1970 (OSHA's), safety and health rules and standards, and shall provide Buyer with a copy of all accident reports prepared by or submitted to SupplierSupplier occurring any such site, including but not limited to all OSHA illness and injury reports. By accepting the Purchase Order, Supplier hereby acknowledges and agrees that it and any of its employees, subcontractors and agents have read such rules and will abide by them. All Services performed hereunder shall fully comply with all applicable governmental safety and health requirements, including but not limited to the rules and standards established by the Occupational Safety and Health Act of 1970, as amended, and any other applicable federal, state and/or local safety or health laws, rules or regulations. Any equipment provided by Buyer to Supplier for the benefit of Supplier's ’s employees or those of its subcontractors shall be or agents are provided on an "“as is" ” basis with no warranty of performance and at the sole risk and liability of Supplier to ensure that such equipment is fit for the use intended and in proper working order. Supplier has a duty to inspect the equipment prior to use, and agrees to defend, indemnify, and hold harmless Buyer from any and all claims, losses or expenses (including reasonable attorneys’ fees) of Supplier, its subcontractors, and all of their respective employees employees, arising out of the use of any equipment furnished by Buyer or advice given by Buyer relating to such equipment equipment. Supplier shall perform the Services and supply the Materials in such a manner as to cause minimum interference with Xxxxx’s operations and the fullest extent allowed by lawoperations of other contractors on Buyer’s site. The results of the background check shall be made available to Buyer’s Human Resources human resources representative upon request. Supplier acknowledges and agrees to comply with Xxxxx's safety requirements and shall ensure that all of Supplier's employees, subcontractors employees and agents doing work on the site are familiar with Xxxxx’s such rules and requirements at any such facility and comply with them. In addition to the forgoing, Supplier shall comply with all applicable federal, state and local laws, regulations and orders and shall, upon request, furnish to Buyer a certificate to such effect. In addition to the safety and health provisions contained in Buyer’s policies and safety requirements, Supplier while performing the Services hereunder, hereunder shall abide by any and all of Supplier's, as well as OSHA's, safety and health rules and shall provide Buyer with a copy of all accident reports prepared by or submitted to Supplier, including but not limited to all OSHA illness and injury reports. Supplier hereby acknowledges and agrees that it and any of its subcontractors have read such rules and will abide by them. All Services performed hereunder shall fully comply with all applicable lawful governmental safety and health requirements, including but not limited to the rules and standards established by the Occupational Safety and Health Act of 1970, as amended, and any other applicable federal, state and/or local safety or health laws, rules or regulations. Supplier shall perform the background check of its employees and subcontractors who will be on Buyer’s premise as specifically required by Buyer at Supplier’s cost.
