Suitability Determination. A “suitability determination” is a determination that there are reasonable grounds to believe that an individual will likely be able to perform the contract requirements on-site without undue risk to the interest of the University.

Suitability Determination. USCIS shall have and exercise full control over granting, denying, withholding or terminating access of unescorted Contractor employees to government facilities and/or access of Contractor employees to sensitive but unclassified information based upon the results of a background investigation. USCIS may, as it deems appropriate, authorize and make a favorable entry on duty (EOD) decision based on preliminary security checks. The favorable EOD decision would allow the employees to commence work temporarily prior to the completion of the full investigation. The granting of a favorable EOD decision shall not be considered as assurance that a full employment suitability authorization will follow as a result thereof. The granting of a favorable EOD decision or a full employment suitability determination shall in no way prevent, preclude, or bar the withdrawal or termination of any such access by USCIS, at any time during the term of the contract. No Contractor employee shall be allowed unescorted access to a Government facility without a favorable EOD decision or suitability determination by the Office of Security & Integrity Personnel Security Division (OSI PSD).

No employee of the Contractor shall be allowed to EOD and/or access sensitive information or systems without a favorable EOD decision or suitability determination by the Office of Professional Responsibility, Personnel Security Unit (OPR-PSU). No employee of the Contractor shall be allowed unescorted access to a Government facility without a favorable EOD decision or suitability determination by the OPR-PSU.
Suitability Determination. Without limiting reasonableness to ------------------------- such circumstances, a determination made by the Affected Venturer referred to in Section 11.2(a) hereof shall be deemed to be reasonable if based upon: (i) any written communication from a gaming regulatory authority of the applicable state; or (ii) written evidence that, if true, the Affected Venturer's participation in the Venture would violate any law, rule or regulation administered by any gaming regulatory authority, so long as such evidence is not induced in bad faith by its recipient.

Suitability Determination. Contractor personnel must be able to obtain a favorable suitability decision in accordance with 5 CFR part 731. The duties to be performed under Calls issued against this BPA range from low risk to high risk positions. Contractor personnel will be required to submit all required documentation necessary for the agency to provide a favorable preliminary decision on suitability. This decision is required prior to commencing work on this BPA or on the Calls issued under this BPA. Contractor personnel who do not receive a favorable preliminary suitability decision are not authorized to perform work under the BPA and the Calls issued against it. Similarly, contractor personnel who receive an unfavorable suitability decision shall be immediately removed.

Suitability Determination. 5.3.2.1 Once a prospective contract employee applies for a position and receives a favorable evaluation by Contractor (i.e., meets the minimum qualification requirements cited in this SOW and otherwise meets Contractor’s hiring criteria), Contractor shall submit Government furnished forms for each contract employee to COTR: ▪ Contractor Information Worksheet ▪ Two completed original Forms FD-258, Fingerprint Chart ▪ Following forms via e-QIP: o DHS Form 11000-9, Disclosure and Authorization Pertaining to Consumer Reports pursuant to Fair Credit Reporting Act o Foreign National Relatives or Associates Statement x Xxxxxxxxxx Amendment Statement o Standard Form (SF) 85P, Questionnaire for Public Trust o Standard Form 85P-S, Supplemental Questionnaire for Selected Positions o Signed e-Verify Confirmation Notice 5.3.2.2 Any investigation conducted by or for another federal agency on an individual that is of same or higher type and scope as one required for position is sufficient to meet investigation requirements if investigation occurred within past five years. 5.3.2.3 Any investigation conducted by or for another federal agency on an individual whose scope is less than that required for position and meets investigation requirements of position is eligible for upgrade if investigation occurred within past five years. 5.3.2.4 Contract employees cleared through this process while employed under a predecessor contract, suitability determination made under previous contract will carry over to new contract. 5.3.2.5 Government may not be able to complete a satisfactory background investigation on individuals not residing in the United States for three of the past five years. In such cases, FPS retains right to deem individual(s) as ineligible due to insufficient background information. 5.3.2.6 FPS shall have and exercise full and complete control over granting, denying, withholding, or terminating suitability decisions for employees. 5.3.2.7 FPS may, as deems appropriate, authorize and grant a temporary suitability decision to contract employees. 5.3.2.8 Issuance of a temporary decision to any contract employee shall not be an assurance that FPS will grant full suitability. 5.3.2.9 Granting of either temporary or full suitability shall in no way prevent, preclude, or bar later withdrawal or termination of any such suitability by Government.
Suitability Determination. ICE-OPR-PSU shall have and exercise full control over granting, denying, withholding or terminating unescorted government facility and/or access to ICE detainees, as well as, when applicable, sensitive Government information access for Service Provider employees, based upon the results of a background investigation. ICE-OPR-PSU may, as it deems appropriate, authorize and make a favorable entry on duty (EOD) decision based on preliminary security checks. The favorable EOD decision would allow the Service Provider employees to commence work temporarily prior to the completion of the full investigation. The granting of a favorable EOD decision shall not be considered as assurance that a full employment suitability authorization will follow as a result thereof. The granting of a favorable EOD decision or a full employment suitability determination shall in no way prevent, preclude, or bar the withdrawal or termination of any such access by ICE-OPR-PSU, at any time during the term of the IGSA. No employee of the Service Provider shall be allowed to EOD and/or access facilities or ICE detainees without a favorable EOD decision or suitability determination by OPR-PSU. No employee of the Service Provider shall be allowed unescorted access to a Government facility without a favorable EOD decision or suitability determination by OPR-PSU. Service Provider employees assigned to the IGSA not needing access to ICE detainees or recurring access to DHS-ICE facilities will not be subject to security suitability screening. Suitability criteria as detailed in ICE Policy Directives that will exclude applicants from consideration to perform under this Agreement include, but not limited to: Felony convictions, or a conviction for any crime that involves violence Conviction of a sex crime Offense/s involving a child victim Pattern of arrests, without convictions, that brings into question a person’s judgment and reliability to promote the efficiency and integrity of the ICE mission. Intentional falsification and/or omission of pertinent personal information Drug and/or Alcohol Abuse Personal conduct to include failure to pay just debts The process for suitability determination includes, but is not limited to, criminal, employment, citizenship, residential and financial records checks and reviews.
