Common use of Operating Instructions Clause in Contracts

Operating Instructions. TOMRA shall provide to the Purchaser, together with the Goods, all operating instructions and information reasonably required by the Purchaser relating to the transport, handling, storage and use of the Goods. TOMRA shall not be liable in any respect with regard to any damages incurred by Purchaser as a result of: (1) Purchaser’s use, maintenance of the Goods in a manner inconsistent with any specifications or instructions related to any such Goods provided by TOMRA, or (ii) any modification of the Goods not authorized or approved by TOMRA or the use of the Goods in a manner not contemplated by the specifications or instructions.
