Common use of Operation and Maintenance Period Clause in Contracts

Operation and Maintenance Period. In addition to any of its other obligation under this Agreement, during the Operation and maintenance Period, the Developer shall manage, operate, maintain the Project and shall repair the project components, whenever required, entirely at its cost, charges, expenses and risk in accordance with the provisions of this Agreement. The Developer's obligations under this Agreement shall include but not be limited to the following: a. Make available all necessary financial, technical, technological, managerial and other resources for operation, maintenance, repair and replacement of the Project and its components in a timely manner b. Manage & operate the project on a common-user basis, open to any and all users and refrain from indulging in any unfair or discriminatory practice against any residential user thereof c. Ensure Maintenance of proper and accurate record/data/accounts relating to operations of the Project and the revenue earned therefrom; d. Comply with applicable laws including those relating but not limited, health, environment and labour;
