Option for Binding Recommendations Clause Samples

The 'Option for Binding Recommendations' clause establishes a mechanism by which parties can agree to have a third party provide recommendations that become contractually binding. In practice, this clause typically outlines the process for selecting the third party, the scope of issues subject to recommendation, and the procedure for implementing the resulting decision. Its core function is to offer a structured alternative to litigation or arbitration, providing a faster and potentially less adversarial way to resolve disputes or make determinations within the contract.
Option for Binding Recommendations. While the grievance investigation process is intended to yield only non-binding recommendations, the Parties may agree that the recommendations will represent a binding award, in the manner of an arbitration award. Any award made in accordance with this article, shall have no precedential value. Such agreement must be made in advance of the appointment of the investigator.
