Common use of Option to Build Clause in Contracts

Option to Build. Interconnection Customer shall have the option to assume responsibility for the design, procurement and construction of new Interconnecting Transmission Owner’s Interconnection Facilities and Stand Alone Network Upgrades on the dates specified in Article 5.1.2. The System Operator, Interconnecting Transmission Owner, and Interconnection Customer must agree as to what constitutes Stand Alone Network Upgrades and identify such Stand Alone Network Upgrades in Appendix A to the LGIA. Except for Stand Alone Network Upgrades, Interconnection Customer shall have no right to construct Network Upgrades under this option.
