Common use of Option to Build Clause in Contracts

Option to Build. Pursuant to Section 7.3.2.5 & 7.3.3.5 of the GIP, Interconnection Customer shall have the option to assume responsibility for the design, procurement and construction of the Transmission Owner’s Interconnection Facilities and Stand Alone Network Upgrades by the dates originally designated by Interconnection Customer under Article 5.1.2. The Parties must agree as to what constitutes Stand Alone Network Upgrades and identify such Stand Alone Network Upgrades in Appendix A. Except for Stand Alone Network Upgrades, Interconnection Customer shall have no right to construct Network Upgrades under this option.
