You further acknowledge that the Park District, through its representatives, have explained the risks associated with the use of a kayak and paddle boat on the Wellington Reservation, including the possibility that the kayak or paddle boat may capsize. You agree to properly wear a life jacket supplied by the Park District at all times while using the kayak or paddle boat and acknowledge that the Park District does not provide any lifeguard or safety personnel to monitor the lake. In consideration for the rental of the kayak or paddle boat from the Park District, you, for yourself and each minor child or children identified below, waive, release and discharge the Park District from any and all claims, causes of action, demands, judgments, damages, liability or obligations of any nature or kind, which may arise or become known later, which accrue on account of, or in any way arise out of or in connection with your rental or use of a kayak or paddle boat. Further, you agree to indemnify and hold the Park District harmless from and against any and all losses, liabilities, claims, obligations, costs, damages, and/or expenses whatsoever, including, but not limited to, any reasonable attorneys’ fees, costs, damages and/or judgments directly or indirectly arising out of, or relating to your acts or omissions while using a watercraft at Wellington Reservation. This Agreement constitutes and contains the entire agreement between you and the Park District relating to the use of the watercraft.
