Common use of Overtime Guarantee Clause in Contracts

Overtime Guarantee. The overtime guarantee set forth herein shall not be applied to those situations where the employee is attending a pre-scheduled meeting; for the pre-scheduled opening or closing of a facility; where there is a need to conduct an inspection during the regular work week, as set forth in 2117.63, “Work Week” but outside the regular working hours and twenty-four (24) hours advance notice is provided; or to attend a required court hearing as a witness in connection with their City employment. In such cases the employee shall be guaranteed two (2) hours pay at the appropriate overtime rate rather than the four (4) hours.
