Owner Reuse or Modification of Work Product. If the Owner reuses or modifies the Work Product without the Consultant’s involvement or prior written consent, to the extent permitted by Article XI, Section 7 of the Oregon Constitution and by the Oregon Tort Claims Act, the Owner shall indemnify, within the limits of the Tort Claims Act, the Consultant against liability for damage to life or property arising from the Owner's reuse or modification of the Work Product, provided the Owner shall not be required to indemnify the Consultant for any such liability arising out of the wrongful acts of the Consultant or the Consultant’s officers, employees, Sub-Consultants, subcontractors, or agents.

Owner Reuse or Modification of Work Product. If the Owner reuses or modifies the Work Product without the Design Professional's involvement or prior written consent, the Owner shall indemnify, in an amount up to two times the Maximum Compensation to be paid under this Agreement, the Design Professional against liability for damage to life or property arising from the Owner’s reuse or modification of the Work Product, provided the Owner shall not be required to indemnify the Design Professional for any such liability arising out of the wrongful acts of the Design Professional or the Design Professional's officers, employees, Consultants, subcontractors, or agents.
