Common use of PAID HOLIDAYS (ARTICLE 15) Clause in Contracts

PAID HOLIDAYS (ARTICLE 15). I.01 The Employer agrees to recognize the following paid holidays: New Year's Day (Jan. 1st) Civic Holiday 3rd Monday in February Labour Day Good Friday Thanksgiving Day Victoria Day Remembrance Day (Nov. 11th) Easter Monday Christmas Day (Dec. 25th) Canada Day (July 1st) Boxing Day (Dec. 26th) I.02 Due to the nature of the services necessary in a Hospital, many of the nurses may be required to work on these holidays. The schedule will not be altered unless the nurses request the holiday off. I.03 Prior to scheduling on paid holidays, the Nursing Unit Manager will consider each nurse's preference for such holiday, provided there is no delay by the nurse in stating the preference. (a) Where a holiday falls during a nurse's scheduled vacation period, and the nurse and the Hospital agree to schedule a different day off with pay, such day shall be scheduled at a mutually agreeable time. (b) Where a holiday falls on a nurse's scheduled day off, an additional day off with pay will be scheduled at a mutually agreeable time. (c) A nurse required to work on any of the foregoing holidays shall be paid in accordance with Article 15.05 of the Collective Agreement, and she/he shall receive a lieu day which shall be scheduled by mutual agreement, concurrently with scheduled weekends off, or vacation. (d) Where a regular part-time nurse has been scheduled to work on a holiday weekend, she/he shall be scheduled to work on the holiday as well, providing the shift is available. (e) A nurse will be permitted to bank up to ninety (90) hours of stat time per calendar year. The bank will be reduced by pay out the first pay period after March 31 of each year until the bank is at thirty-seven and one-half (37.5) hours which shall be permitted at all times.

H.02 In general, nurses will alternate with each other in being absent from work on holidays - for instance, a nurse having Christmas Day off might not be allowed off on New Year's Day. In general, nurses will alternate their scheduled days off for Christmas or New Year's on an alternating yearly basis. For example, a nurse who was off for Christmas one (Dec. 1) year would be expected to be off for New Year's the next year, unless mutually agreed upon by the Nursing Unit Manager and all nursing unit staff have had their holiday needs met. The Hospital will schedule the nurses off a minimum of five (5) consecutive days and will endeavour to schedule them off up to seven (7) consecutive days at either Christmas or New Year’s. Christmas shall be defined as any tour which commences on December 24th, 25th and 26th) I.02 Due . New Year's shall be defined as any tour that commences on December 31st, January 1st and January 2nd. Failure to schedule a minimum of five (5) days off will result in premium pay to the nature affected nurses. The schedule covering the Christmas and New Year's period will be posted on November 1st of each year. The Christmas and New Year's schedule will cover shifts between December 15th and January 15th. The Union agrees that the services necessary normal scheduling patterns will be waived during this holiday period to accommodate the five (5) days off. Nurses that work in a Hospitaldepartments that are closed over Christmas and New Year’s, many of the nurses may be required to work on these holidays. The schedule will not be altered unless take call during the nurses request the holiday offclosure. I.03 Prior to scheduling on paid holidays, the Nursing Unit Manager will consider each H.03 A nurse's preference shall be considered before posting of schedules for such any holiday, provided there is no delay by the nurse in stating the preference. Scheduling of lieu days, regardless of shift, shall be by mutual consent [within forty (40) days on either side of the holiday]. (a) H.04 Where a holiday falls during a nurse's scheduled vacation period, and the nurse and the Hospital agree to schedule a different day off with pay, such day shall be scheduled at a mutually agreeable time. (b) Where a holiday falls on a nurse's scheduled day off, an additional day off with pay will be scheduled at a mutually agreeable time. (c) A nurse required to work on any of the foregoing holidays shall be paid in accordance with Article 15.05 of the Collective Agreement, and she/he shall receive a lieu day which shall be scheduled by mutual agreement, concurrently with scheduled weekends off, or vacation. (d) Where a regular part-time nurse has been scheduled to work on a holiday weekend, she/he shall be scheduled to work on the holiday as well, providing if requested by the shift is availablenurse prior to the posting of the schedule.
