Common use of Parking Requirements Clause in Contracts

Parking Requirements. Owner grants Manager the right to use the parking facilities that are a part of the Premises pursuant to the REA (the "Parking Spaces") for the temporary parking of automobiles or similarly sized light trucks or utility vehicles during the Term of this Agreement. Manager's rights to use Manager's Parking Spaces are nonexclusive and subject to the terms of the REA and are conditioned upon this Agreement being in full force and effect and there being no default hereunder. Manager will not abuse its privileges with respect to Manager's Parking Spaces and will use the same in accordance with the REA or Restrictive Agreements. In no event will Manager use more than the number of Manager's Parking Spaces available under the REA or other Restrictive Agreement. Owner's inability to make any of Manager's Parking Spaces available at any time during the Term for reasons beyond Owner's control will not be deemed a default by Owner giving rise to any claim by Manager. Owner will have no liability to Manager with respect to Manager's use of Manager's Parking Spaces, including any liability for any property that is lost, stolen, damaged or destroyed as a result of or in connection with such use.
