When we receive a Payment Instruction from you, you authorize us to debit your Eligible Transaction Account and remit funds on your behalf. You also authorize us to credit your Eligible Transaction Account for the receipt of payments, including but not limited to those payments returned to us from Receivers to whom you sent payment(s) or cancelled and returned to you because the processing of the payment transaction could not be completed. You agree that we will not be liable in any way for any payments that you may receive, regardless of whether you authorized the Sender to send them to you. We will use reasonable efforts to complete all your payment transactions properly. However, we shall incur no liability if we are unable to complete any transaction because of the existence of any one or more of the following circumstances: If, through no fault of ours, the Eligible Transaction Account does not contain sufficient funds to complete the payment transaction or the payment transaction would exceed the credit limit of your overdraft account; The Service is not working properly and you know or have been advised by us about the malfunction before you execute the payment transaction; The payment is refused as described in Section 20 below; You have not provided us with the correct information, including but not limited to the correct Payment Instructions or Eligible Transaction Account information, or the correct name and address or mobile phone number of the Receiver to whom you are initiating a payment transaction; and/or, Circumstances beyond our control (such as, but not limited to, fire, flood, network or system down time, issues with the financial institution, or interference from an outside force) prevent the proper execution of the payment transaction and we have taken reasonable precautions to avoid those circumstances. It is the responsibility of the Sender and the Receiver to ensure the accuracy of any information that they enter into the Service (including but not limited to the Payment Instructions and name, telephone number and/or email address that the Sender enters for the Receiver to whom you are sending the payment transaction), and for informing us as soon as possible if they become aware that this information is inaccurate. Neither the Sender nor Receiver may use a P.O. Box as a postal address. We will make a reasonable effort to stop or recover a payment transaction made to the wrong person or entity once informed, but we do not guarantee such stoppage or recovery and will bear no responsibility or liability for damages resulting from incorrect information entered by the Sender or Receiver. Payment Authorization and Payment Remittance. a. By providing us with names and and/or telephone numbers, numbers and/or email addresses, addresses and/or bank account information of Receivers to whom you wish to direct payments, you authorize us to follow the Payment Instructions that we receive through the Service. .
b. When we receive a Payment Instruction from you, you authorize us to debit your Eligible sending Transaction Account and remit funds on your behalf. You also authorize us to credit your Eligible receiving Transaction Account for the receipt of payments, including but not limited to those payments returned to us from Receivers to whom you sent payment(spayments(s) or cancelled and returned to you because the processing of the payment transaction could not be completed. You acknowledge and agree that if your Payment Instructions identify an account by name and account number, the relevant financial institution may execute those Payment Instructions by reference to the account number only, even if such account number does not correspond to the account name. You further acknowledge and agree that financial institutions holding the account may choose to not investigate discrepancies between account names and account numbers.
c. Once registered, you as a Receiver authorize us to credit your Transaction Account for payments remitted to you on behalf of a Sender without further approval from you. You agree that we will not be liable in any way for any payments that you may receive, regardless of whether you authorized the Sender to send them to you. If you do not register, then funds will not be transferred to you from the Sender’s Transaction Account, and the payment transaction will be cancelled.
d. We will use reasonable efforts to complete make all your payment transactions payments properly. However, we shall incur no liability if we are unable to complete any transaction payments initiated by you because of the existence of any one or more of the following circumstances: :
1. If, through no fault of ours, the Eligible Transaction Account does not contain sufficient funds to complete the payment transaction or the payment transaction would exceed the credit limit of your overdraft account; .
2. The Service is not working properly and you know or have been advised by us about the malfunction before you execute the payment transaction; ;
3. The payment is refused as described in Section 20 section 7 below; .
4. You have not provided us with the correct information, including but not limited to the correct Payment Instructions instructions or Eligible Transaction Account information, or the correct name and email address or mobile phone number of the Receiver to whom you are initiating sending a payment transactionpayment; and/or,
5. Circumstances beyond our control (such as, but not limited to, fire, flood, network or system down time, issues with the financial institution, or interference from an outside force) prevent the proper execution of the payment transaction and we have taken reasonable precautions to avoid those circumstances. .

Payment Authorization and Payment Remittance. By initiating a payment through the Service, you authorize XXXXXXXXXXXX.XXX to charge the account that you designate as the account to which the bill payments should be charged or withdrawn from (the "Funding Account"). You further acknowledge and agree that financial institutions holding the account may choose to not investigate discrepancies between account names and account numbers and that we have no responsibility to investigate discrepancies between account names and account numbers.
4. You agree that we will not be liable in any way for any payments that you may receive, regardless of whether you authorized the Sender to send them to you. We will use reasonable efforts to complete all your payment transactions properly. When we receive a Payment Instruction from youInstruction, you authorize us to debit your Eligible Transaction Account primary deposit account and remit funds on your behalfbehalf to your Xxxxxx so that the funds arrive on or as soon as reasonably possible after the Pay Date designated by you. You also authorize us to credit your Eligible Transaction Account primary deposit account for the receipt of payments, including but not limited to those payments returned to us by the United States Postal Service or Xxxxxx. We will use our commercially reasonable efforts to make all your payments properly, and if we do not complete a payment from Receivers your primary deposit account on time or in the correct amount according to whom you sent payment(s) or cancelled and returned to you because the processing of the payment transaction could not be completed. You agree that this Agreement we will not be liable in any way for any payments that you may receiveyour losses, regardless of whether you authorized costs or expenses except for your direct losses or damages to the Sender extent directly relating to send them to youour gross negligence or intentional misconduct. We will use reasonable efforts to complete all your payment transactions properly. However, we shall incur no liability if we are unable to complete any transaction payments initiated by you because of the existence of any one or more of the following circumstances: :

You have not provided us with the correct information, including but not limited to the correct Payment Instructions or Eligible Transaction Account account information, or the correct name and address or mobile phone number of the Receiver to whom you are initiating a payment transactionPayment Instructions; and/or, ,

Circumstances beyond our control (such as, but not limited to, fire, flood, network or system down time, issues with the financial institution, pandemic or interference from an outside force) prevent the proper execution of the payment transaction and we have taken reasonable precautions to avoid those circumstances. 2. The Service is not working properly and you know or have been advised by us about the malfunction before you execute the payment transaction; ;

You have not provided us with the correct information, including but not limited to the correct Payment Instructions instructions or Eligible Transaction Account information, or the correct name and email address or mobile phone number of the Receiver to whom you are initiating sending a payment transactionpayment; and/or,

Circumstances beyond our control (such as, but not limited to, fire, flood, network or system down time, issues with the financial institution, or interference from an outside force) prevent the proper execution of the payment transaction and we have taken reasonable precautions to avoid those circumstances. .

6. If we received incorrect or incomplete information from you or from third parties (e.g., the U.S. Treasury or an automated clearing house);
7. If you, or anyone you allow, commits any fraud or violates any law or regulation or if any transaction is prohibited by law, regulation, court order, or would be considered illegal activity;
8. If our failure to complete the transaction is done to protect the security of your Eligible Transaction Account and/or the Site;
9. If the payee mishandles or delays a payment transaction; The sent through the Service;
10. If delays in processing and/or payment is refused as described in Section 20 below; are caused by third-party software and/or services;
11. Neither the Sender nor Receiver may use a P.O. Box as a postal address. We will make a reasonable effort to stop or recover a payment transaction made to the wrong person or entity once informed, but we do not guarantee such stoppage or recovery and will bear no responsibility or liability for damages resulting from incorrect information entered by the Sender or Receiver. In this End Users Agreement, the words “I,” “me,” “my,” “us” and “our” mean the (consumer or business) that applied for and/or uses any of the Remote Deposit Capture Services (the “Services”) described in this End Users Agreement. The words “your Credit Union,” “our Credit Union,” and “the Credit Union” mean Farmers Insurance Federal Credit Union. My Application for use of the services, your notification of approval of my application, and my Credit Union (Account Agreement and Disclosures) are hereby incorporated into and made a part of this End Users Agreement. In order to process payments more efficiently and effectively, you agree that we may edit or alter payment data or data formats in accordance with Xxxxxx directives. When we receive a Payment Instruction from youInstruction, you authorize us to debit your Eligible Transaction Account primary deposit account and remit funds on your behalfbehalf to your Xxxxxx so that the funds arrive on or as soon as reasonably possible after the Pay Date designated by you. You also authorize us to credit your Eligible Transaction Account primary deposit account for the receipt of payments, including but not limited to those payments returned to us by the United States Postal Service or Xxxxxx. We will use our commercially reasonable efforts to make all your payments properly, and if we do not complete a payment from Receivers your primary deposit account Card on time or in the correct amount according to whom you sent payment(s) or cancelled and returned to you because the processing of the payment transaction could not be completed. You agree that this Agreement we will not be liable in any way for any payments that you may receiveyour losses, regardless of whether you authorized costs or expenses except for your direct losses or damages to the Sender extent directly relating to send them to youour gross negligence or intentional misconduct. Circumstances beyond our control (such as, but not limited to, fire, flood, network or system down time, issues with the financial institution, pandemic or interference from an outside force) prevent the proper execution of the payment transaction and we have taken reasonable precautions to avoid those circumstances.
