Payment of Wages Pending Drug Test. If pre-employment drug testing is required, the Individual Employer shall not delay paying wages and benefits to any employee who is dispatched and undergoes drug testing. Any employee who submits to such drug testing shall be placed on the payroll of the Individual Employer prior to the test and shall be paid according to the reporting time provisions of this Agreement for the first day that the employee reports. Thereafter, until receipt of final drug test results, the Individual Employer shall pay such employee for each regular work day, based on a work day of eight (8) hours, regardless of the number of hours of work performed, if any.

  • Payment of Non-compliance Penalties j) Subject to Clause (i) above, the Service Provider shall pay the Non-compliance Penalty indicated in the Non-compliance Penalty Certificate within 10 (ten) Business Days of Transnet issuing a valid Tax Invoice to the Service Provider for the amount set out in that certificate. If Transnet does not issue a valid Tax Invoice to the Service Provider for Non-compliance Penalties accrued during any relevant period, those Non-compliance Penalties shall be carried forward to the next period.

  • Submitting False Claims; Monetary Penalties The AOC shall be entitled to remedy any false claims, as defined in California Government Code section 12650 et seq., made to the AOC by the Contractor or any Subcontractor under the standards set forth in Government Code section 12650 et seq. Any Contractor or Subcontractor who submits a false claim shall be liable to the AOC for three times the amount of damages that the AOC sustains because of the false claim. A Contractor or Subcontractor who submits a false claim shall also be liable to the AOC for (a) the costs, including attorney fees, of a civil action brought to recover any of those penalties or damages, and (b) a civil penalty of up to $10,000 for each false claim.
