Payments by Lessor. All moneys received by the Lessor pursuant to the Lease including, but not limited to, payments of Basic Rent, Supplemental Rent, the Termination Value or the Final Rent Payment, except for amounts allocable to fees and expenses of the Lessor pursuant to the Operative Documents and amounts comprising Supplemental Rent payable to third Persons, if any, shall be paid to the Funding Parties in accordance with, and to pay amounts owing pursuant to, the terms of this Agreement, including without limitation Section 4.01 and, if applicable, Section 3.05.
Payments by Lessor. 8.6 If any sum paid to Lessor or recovered by Lessor in respect of the liabilities of Lessee under this Agreement is less than the amount then due, Lessor may apply that sum to amounts due under this Agreement in such proportions and order and generally in such manner as Lessor may, acting reasonably, determine.
Payments by Lessor. Notwithstanding any provision of this Lease to the contrary, Lessor shall not be obligated to make any payment or to release any money to Lessee if a Specified Default shall have occurred and be continuing but shall be entitled to hold such money as provided in Section 4.09 until any such Specified Default shall no longer be continuing, PROVIDED, HOWEVER, that if an Event of Default occurs, Lessor shall be entitled to apply such money to any Rent or other obligation owed by Lessee to Lessor hereunder.
Payments by Lessor. If Lessee shall fail to make any of the payments to third parties or fail to take any action at Lessee's expense required hereunder, Lessor may, at Lessor’s option on Lessee's behalf, take the required action, and any amount shall be payable on demand with interest at the maximum rate of % as allowed by the State of per annum from the date of expenditure. Payments by Lessor. If Lessee shall fail to make any payment or perform any act required hereunder (including, but not limited to, maintenance of any insurance required by Section 12), then Lessor may, but shall not be required to, after such notice to Lessee as is reasonable under the circumstances, make such payment or perform such act with the same effect as if made or performed by Lessee. Lessee will upon demand reimburse Lender for all sums paid and all costs and expenses incurred in connection with the performance of any such act.
Payments by Lessor. If Lessee fails to pay operation, repair or maintenance expenses or taxes, assessments and other charges as required by Sections 7.1 and 7.2, or to pay insurance premiums or to maintain insurance as required by Section 7.3, Lessor, or Trustee, may (but shall not be obligated to), upon 10 days, advance written notice to Lessee, advance and apply moneys to pay any such required charges or items. Any moneys so advanced shall be payable by Lessee as Additional Rent on written demand therefor and shall bear interest from the date of advancement at the Interest Rate for Advances.
Payments by Lessor. Xxxxxx agrees to pay, and to indemnify Lessee from and against all legal costs and charges, including reasonable attorneys' fees, lawfully and reasonably incurred in obtaining a final judgment, order or decree that is not subject to further appeal enforcing any term, covenant, condition, obligation or agreement on the part of Lessor to be performed or met under this Lease.
Payments by Lessor. All moneys received by the Lessor, or by the Agent for the account of the Lessor, pursuant to the Lease including, but not limited to, payments of Basic Rent, Supplemental Rent, the Termination Value or the Final Rent Payment or the Completion Costs Payment, as applicable, except for amounts allocable to fees and expenses of the Lessor pursuant to the Transaction Documents and amounts comprising Supplemental Rent payable to third Persons, if any, shall be paid to the Lessor, the Agent and the Lenders, as the case may be, in accordance with, and to pay amounts owing pursuant to, the terms of this Agreement, including without limitation Section 4.01 and, if applicable, Section 3.05.
Payments by Lessor. At its option, the Lessor may ------------------ discharge past due taxes, assessments, charges, fees, Liens, security interests or other encumbrances at any time levied or placed on the Vehicles and not constituting Permitted Liens, and may pay for the maintenance and preservation of the Vehicles to the extent the Lessee fails to do so as required by this Agreement, and Lessee agrees to reimburse the Lessor on demand for any payment made or any expense incurred pursuant to the foregoing authorization; provided, -------- however, that nothing in this Section 24 shall be interpreted as excusing the ------- ---------- Lessee from the performance of, or imposing any obligation on the Lessor to cure or perform, any covenants or other promises of the Lessee with respect to taxes, assessments, charges, fees, liens, security interests or other encumbrances and maintenance as set forth herein.
