PEG Access Channels. (a) Subject to Section 3.1 supra, no later than eighteen (18) months from the Execution Date of the Final License, the Licensee shall make available to the Issuing Authority and/or its designee(s), six (6) full-time Downstream Channels for PEG Access purposes on the Subscriber Network. There shall be no charges and/or costs whatsoever to the Issuing Authority, the Town, program originators, and/or Subscribers for such capacity. (b) The Licensee shall make available four (4) Upstream Channels, or the equivalent thereof, for remote cablecasting of PEG Access Programming and/or interconnection to said six (6) PEG Access Downstream Channels. To the extent that one or more of said Upstream Channels are not available on the Subscriber Network, the Licensee shall make such upstream capacity available to the Town from any location on the Cable System, including any interface equipment that may be necessary on account of such upstream capacity not being on the Subscriber Network. There shall be no charges and/or costs whatsoever to the Issuing Authority, the Town, program originators, and/or Subscribers for such equivalent capacity and/or interface equipment. (c) Said PEG Access Channels shall be used to transmit PEG Access Programming to Subscribers without charge to the Issuing Authority, its designee(s), the Town, program originators, and/or Subscribers, and shall be subject to the control and management of the Issuing Authority and/or its designee(s). (d) Except as required by applicable law, rule or regulation, the Licensee shall employ its best efforts to use Channels 42, 47, 52, 53, 77 and 78 on the Subscriber Network as the channel locations of the PEG Access Downstream Channels. The Licensee shall not change said channel locations, without the advance, written consent of the Issuing Authority, which consent shall not be unreasonably withheld.

There shall be no charges and/or costs whatsoever to the Issuing Authoritypurposes, the Town, program originators, and/or Subscribers for such capacity.
(b) The Licensee shall make available four (4) Upstream Channels, or the equivalent thereof, for remote cablecasting of PEG Access Programming and/or interconnection to said six (6) PEG Access Downstream Channels. (c) Said PEG Access Channels which shall be used to transmit non-commercial PEG Access Programming to Subscribers without charge Subscribers, at no cost to the Issuing Authority, its designee(s), Town and/or the Town, program originators, and/or Subscribers, Access Corporation and shall be subject to the control and management of the Issuing Authority and/or its designee(s)the Access Corporation.
(db) Except as required by applicable lawIf, rule over the course of any six (6) month period during the term of this Renewal License, all three (3) of the PEG Access Channels, referenced in paragraph (a) above, are programmed with original, non-repeated, locally-produced Programming (excluding alpha-numeric “bulletin board” programming) for seventy five percent (75%) or regulationmore of the time during the hours between 10:00am and 11:00pm, the Issuing Authority may so notify the Licensee, in writing. Included in such notification shall be copies of program logs and other records verifying such usage for said period of time, and original logs and other records shall be made available to the Licensee upon request. After receipt of such notification and verification to the Licensee’s reasonable satisfaction, the Licensee shall employ shall, at the Issuing Authority’s request, make available to the Issuing Authority and/or the Access Corporation, as designated by the Issuing Authority, capacity on its best efforts to use Channels 42, 47, 52, 53, 77 and 78 Basic Service Tier available for one (1) additional PEG Access Downstream Channel. This Section 6.3(b) does not constitute an obligation on the Licensee to add additional Subscriber Network as Downstream Channel capacity at any time during this Renewal License term.
(c) The Licensee shall not move or otherwise relocate the channel locations of the PEG Access Downstream Channels. The Licensee shall not change said channel locations, referenced in paragraphs (a) & (b) above, without the advance, written consent of notice to the Issuing Authority, which consent shall not be unreasonably withheldAuthority and/or its designee(s).

PEG Access Channels. More specifically, on the Effective Date of this Renewal License, the Licensee shall provide six (6) full-time Downstream Channels downstream analog channels to cable Subscribers for PEG Access purposes on currently comprising Channels 8, 9, 10, 22, 98, and 99. Licensee shall throughout the Subscriber Networkterm of this Renewal License continue to provide a minimum of six (6) downstream PEG Access Channels. There Additional downstream channel capacity for PEG Access shall be no charges and/or costs whatsoever to provided when the Issuing Authority, channel usage trigger in Section 6.4(e) and the Town, program originators, and/or Subscribers for such capacityconditions in Section 6.4(f) have been achieved.
(b) The Licensee Issuing Authority shall make available four (4) Upstream Channels, or the equivalent thereof, for remote cablecasting of allocate PEG Access Programming and/or interconnection to said six (6) PEG Access Downstream Channels. To the extent that one or more of said Upstream Channels are not available on the Subscriber Network, the Licensee shall make such upstream Channel capacity available to the Town from any location on the Cable System, including any interface equipment that may be necessary on account of such upstream capacity not being on the Subscriber Network. There shall be no charges and/or costs whatsoever to the Issuing Authority, the Town, program originators, and/or Subscribers for such equivalent capacity and/or interface equipmentas provided in Sections 6.4 and 6.5.
(c) Said For purposes of this Section 6.4 and for all other sections of this Renewal License that may relate to this Section 6.4, the term ―channel‖ shall refer to the channel capacity use that is delivered to Subscribers in the Service Area. The PEG Access Channels shall Channel capacity that is to be provided must be capable of transmitting Signals and can be used to transmit video and audio Signals only, or other information. The PEG Signal must be viewable by all Subscribers, whether they receive digital or analog Service, without the need for any equipment other than the equipment that a Subscriber requires to receive the lowest cost tier of Service, or the equipment necessary to receive the level of Service to which the Subscriber has subscribed. The Cable System, including the PEG Access Programming Channels, shall meet or exceed the FCC’s technical standards set forth in 47 CFR 76 Subpart K, as they may from time to Subscribers without charge to the Issuing Authority, its designee(s), the Town, program originators, and/or Subscribers, and shall time be subject to the control and management of the Issuing Authority and/or its designee(s)amended.
(d) Except as Licensee shall be required by applicable law, rule or regulationto deliver its downstream PEG Access Channels pursuant to Section 6.4 (a) to Subscribers in an analog format unless and until all other channels on the Cable System are delivered in a digital format. At such time that all other downstream Subscriber channels on the Cable System are delivered in digital format, the Licensee shall employ its best efforts provide the necessary transmission and reception equipment (but not production or recording equipment) to use Channels 42allow the City, 47the School Department, 52, 53, 77 and 78 the Access Corporation to deliver PEG Access Programming to Licensee and to Subscribers in a digital format.
(e) At such time that all other downstream Subscriber channels on the Subscriber Network Cable System are delivered in digital format, notice of which shall be provided by the Licensee to the Issuing Authority pursuant to Section 8.2(a), infra, the Licensee shall provide additional channel capacity for PEG use as follows:
(1) A seventh (7th) PEG Access Channel upon six (6) months’ written notice by the Issuing Authority requesting a seventh (7th) PEG Access Channel and meeting the conditions set forth in Section 6.4(f), infra.
(2) An eighth (8th) PEG Access Channel upon six (6) months’ written notice by the Issuing Authority requesting an eighth (8th) PEG Access Channel and meeting the conditions set forth in Section 6.4(f) infra. Such written request from the Issuing Authority for the eighth (8th) PEG Access Channel shall be made no sooner than twelve (12) months after the activation of the seventh (7th) PEG Access Channel.
(f) During ten (10) consecutive weeks, a pre-existing channel designated for the same purpose as the channel locations requested (public or educational or governmental access) cablecasts at least seventy (70) hours per week of ―qualified‖ Programming. For purposes of calculating the PEG Access Downstream Channels. The Licensee shall not change said channel locations70 hours per of week of qualified Programming, without a program may be counted only when it is initially aired during the advance, written consent of the Issuing Authority, which consent shall not be unreasonably withheldten (10) week ―test‖ period.
