PENALTIES PURSUANT TO HEALTH &. SAFETY CODE § 25249.7(b)
3.1 Civil Penalty Payment Pursuant to Health & Safety Code § 25249.7(b). InterMetro shall make a civil penalty payment of $400.00 in accordance with this section, on or before the Effective Date. The penalty payment will be allocated in accordance with California Health & Safety Code § 25249.12(c)(1) & (d), with 75% of the funds remitted to the California Office of Environmental Health Hazard Assessment (“OEHHA”) and the remaining 25% of the penalty remitted to DiPirro in accordance with Section 3.2 below. The penalty payment shall be remitted in accordance with the procedure set out in Section 3.2.

3.1 (a). One check made payable to the State of California’s Office of Environmental Health Hazzard Assessment (“OEHHA”) in the amount of one thousand one hundred and twenty-five dollars ($1,125), representing 75% of the total civil penalty; and
(b) One check payable to “Clean Product Advocates, LLC” in the amount of three hundred and seventy-five dollars ($375), representing 25% of the total civil penalty.

The penalty payment will be allocated in accordance with California Health & Safety Code § 25249.12(c)(1) & (d), with 75% of the funds remitted to the California Office of Environmental Health Hazard Assessment (“OEHHA”) and the remaining 25% of the penalty remitted to XxXxxxx in accordance with Section 3.2 below. The penalty payment shall be delivered to the address listed in Section 3.2 below.

(B) Five hundred dollars ($500) of the Settlement Amount shall be considered a “civil penalty” pursuant to California’s Health and Safety Code. Dongwon shall issue two separate checks within ten (10) days of the Effective Date for a total amount of five hundred dollars ($500) as follows, and all payments shall be delivered to the addresses listed below.
3.1 (a). One check made payable to the State of California’s Office of Environmental Health Hazzard Assessment (“OEHHA”) in the amount of three hundred and seventy-five dollars ($375), representing 75% of the total civil penalty; and
(b) One check payable to “Clean Product Advocates, LLC” in the amount of one hundred and twenty-five dollars ($125), representing 25% of the total civil penalty.

1. The Civil Penalty payment(s) shall be delivered to the addresses identified in § 3.2, below. For all amounts due and owing that are not received within the payment times set forth below, Fiskars shall pay a late civil penalty payment fee equal to $100/day to be allocated in accordance with California Health & Safety Code § 25249.12(c)(1) and (d).

XxXxxxx’x counsel shall be responsible for delivering OEHHA’s portion of any penalty payment made under this Settlement Agreement.
