Performance Measurements. Upon a particular Commission’s issuance of an Order pertaining to Performance Measurements in a proceeding expressly applicable to all CLECs generally, BellSouth shall implement in that state such Performance Measurements as of the date specified by the Commission. Performance Measurements that have been Ordered in a particular state can currently be accessed via the internet at xxxx://xxxx.xxxxxxxxx.xxx. The following Service Quality Measurements (SQM) plan as it presently exists and as it may be modified in the future, is being included as the performance measurements currently in place for the state of Tennessee. At such time that the TRA issues a subsequent Order pertaining to Performance Measurements, such Performance Measurements shall supersede the SQM contained in the Agreement. Performance Measurements. 3.1 Payment-Eligible PIDs and Submeasurements. There are two types of standards, “parity” and “benchmark.” 3.2.1 Parity standards apply statistical and other related calculations defined in Sections 4.0 through 8.0 to determine whether reported performance results meet parity standards or trigger payments. 3.2.2 Benchmark standards do not apply statistical methodologies, but instead apply a “stare and compare” approach and other calculations defined in Sections 4.0 through 8.0 to determine whether the reported performance results meet benchmarks or trigger payments. 3.2.3 Where applicable elsewhere in the PAP, this provision modifies other provisions and operates as follows: For any benchmark or non-interval parity performance sub-measure, CenturyLink QC shall apply one allowable miss to a sub- measure disaggregation that otherwise would require 100% performance before the performance is considered as non-conforming to standard (1) if at the CLEC- aggregate level, the performance standard is met or (2) where the CLEC-aggregate performance must be 100% to meet the standard, the CLEC-aggregate performance is conforming after applying one allowable miss at that level.
Performance Measurements. 3.1 The performance measurements that are in the PAP and either (1) subject to the PAP payment mechanisms or (2) not subject to the PAP payment mechanisms but subject to the Reinstatement/Removal Process set forth in section 3.2 below are identified in Attachment 1 and sections 6.3 and 7.4. Performance Measurements. The Parties agree that the services offered and rendered by BellSouth pursuant to this Agreement shall be provisioned at parity to the service levels and intervals for which BellSouth performs such services for itself, its Affiliates or any other Person or Telecommunications Carrier. The Parties further agree that the service level specified for each item addressed by the Performance Measurements set forth in Attachment 9 shall be at parity. BellSouth agrees to meet the performance standard of parity as measured by the relevant Performance Measurements for each reporting period during the term of this Agreement and any extension thereof. In addition to the service quality measurements described in Attachment 9, no later than third quarter of 2000, BellSouth shall also provide to e.spire a disaggregation report for the provisioning and maintenance of (1) enhanced extended links (“EELs”) and (2) Frame Relay resale. These additional disaggregation reports shall be provided to e.spire as a separate, e.spire-specific report published each month on BellSouth’s PMAP website rather than as part of the standard service quality measurements.

Performance Measurements. If and to the extent the Commission establishes standards to measure the performance of RTOs and/or independent system operators, ISO shall provide the Participants Committee and Individual Participants with reports of its performance against those standards. In addition, ISO shall identify in writing any action it plans to take in response to its measured performance relative to those standards and shall include in its periodic reports the status of any uncompleted commitments so identified.

Performance Measurements. The Parties acknowledge that the Public Service Commission of Wisconsin (“Commission”) in Case No. 6720-TI-160 adopted performance measurements and a remedy plan. The Parties also acknowledge that in Case No. 01-CV-011200 (“Stay Order”), the Wisconsin Circuit Court of Milwaukee County stayed the implementation of portions of the Order issued by the State Commission. Accordingly, CLEC and SBC-AMERITECH agree that: 32.1 Expressly subject to Section 32.5, SBC-AMERITECH shall implement Performance Measurements and a remedy plan approved by the Commission in Case No. 6720-TI-160 or any relevant successor dockets, as well as the state-specific Business Rules developed in relation to such Performance Measurements and remedy plan on the earliest of the following dates: (a) the date when SBC-AMERITECH voluntarily agrees to implement a Performance Measurement and Remedy Plan that is approved by the State Commission or (b) the date when the Stay Order has been lifted or a court of law with competent jurisdiction has affirmed the Commission’s decision in Case No. 6720-TI-160 (“Implementation Date”). No further Amendment of this Agreement shall be necessary in order to implement the Performance Measures and Remedy Plan. To the extent the FCC issues an order related to Performance Measurements and remedies that expressly preempts the Commission’s authority on these issues, either party may invoke its rights under Article XXIX. SBC-AMERITECH agrees to post the Business Rules on SBC-AMERITECH’s Internet website. 32.2 The Performance Measurements and remedy plan referred to herein, notwithstanding any provisions in any other Article or Schedule of this Agreement, are not intended to create, modify or otherwise affect parties’ rights and obligations with respect to OSS access. The existence of any particular performance measure, or the language describing that measure, is not evidence that CLEC is entitled to any particular manner of access, nor is it evidence that SBC-AMERITECH is limited to providing any particular manner of access. The Parties’ rights and obligations to such access are defined elsewhere, including the relevant laws, FCC and Commission decisions/regulations, tariffs, and within this interconnection agreement. 32.3 In addition to the exclusions described in the performance measures and Remedy Plan ordered by the Commission, SBC-AMERITECH shall not be obligated to pay remedies, liquidated damages or assessments for noncompliance with a performance measureme...
