Permissible Use and Usage Limits. FWI offers different types of Visual Communications Software Licenses and Visual Communication Software Products to satisfy various use cases. The specific uses afforded for each type of Visual Communications Software License and/or Product are set out in the Opportunity Document(s) and in the Documentation. Nothing within the grant of a Visual Communications Software License affords You the right to broadcast content to unlimited endpoints unless such right is expressly afforded in the individual Visual Communications Software License purchased, which shall depend upon the use case at issue. You agree to utilize each Visual Communications Software License and Visual Communication Software Products in accordance with its stated terms. You also agree to permit FWI, upon reasonable advance written notice, to audit at its sole discretion Your use of the Visual Communications Software Licenses purchased to ensure such Visual Communications Software Licenses are being utilized in accordance with their stated terms as set forth in this Agreement, the Opportunity Document(s) and the Documentation. Such audits shall be limited to the use of the Visual Communications Software. FWI shall cooperate with You to perform such audit at a time and in a manner that does not significantly disrupt Your operations. You shall be responsible for any additional fees attributed to a failure to comply with permissible usage. You shall utilize the Visual Communications Software exclusively for the purpose identified in the Opportunity Documents and Documentation and for no other purpose. Specifically, you shall not utilize the Visual Communications Software to compete with FWI as it relates to other visual communications software.

  • Permissible Uses Operators may use sick leave for absence due to the operator's illness, injury, doctor's or dentist's appointments (limited to the time of the appointment plus reasonable travel time), exposure to contagious disease which could be communicated to other operators, and absence due to illness, injury or death in the operator's immediate family, when the operator's presence is necessary. In the event that the City offers an alternative assignment on a temporary basis to an employee who is unable to perform his/her normal job duties due to work-related injury or illness and the City provides reasonable productive accommodations for the employee, and the employee refuses to return to work, the employee may not use sick leave for their absence. The assignment shall be consistent with the employee’s physician’s return to work restrictions. Interpretation of immediate family in terms of serious illness, or injury is generally determined to be the spouse, parents, (either natural, step, xxxxxx or in-law), siblings, children (natural, step, xxxxxx or in-law) and other relatives living in the operator's household. However, the Communications Director is authorized to evaluate the individual operator's family relationship in determining what other family members might be considered to be immediate family because of the closeness of their relationship. For purposes of bereavement leave the immediate family shall include spouse, parent, parent-in-law, step-parent, child, step-child, brother, sister, grandparent, grandchild, half-brother, half-sister, grandparent-in-law, brother-in-law, sister-in-law, son-in-law, daughter-in-law and other relatives living in the employee’s household, or any person for whom an employee serves as legal guardian. Upon the death of a qualifying family member up to three (3) work days of bereavement leave shall be granted by the City. The Communications Director may extend such leave up to a total of seven (7) workdays. The Director may require verification for the use of bereavement leave. Bereavement leave days shall be deducted from accrued sick leave days.

  • Usage Limits Services and Content are subject to usage limits, including, for example, the quantities specified in Order Forms and Documentation. Unless otherwise specified, (a) a quantity in an Order Form refers to Users, and the Service or Content may not be accessed by more than that number of Users, (b) a User’s password may not be shared with any other individual, and (c) except as set forth in an Order Form, a User identification may only be reassigned to a new individual replacing one who will no longer use the Service or Content. If You exceed a contractual usage limit, We may work with You to seek to reduce Your usage so that it conforms to that limit. If, notwithstanding Our efforts, You are unable or unwilling to abide by a contractual usage limit, You will execute an Order Form for additional quantities of the applicable Services or Content promptly upon Our request, and/or pay any invoice for excess usage in accordance with Section 6.2 (Invoicing and Payment).

  • Usage Limitations Services may be subject to other limitations, such as, for example, but without limiting the generality of the foregoing, limits on disk storage space, on the number of calls You are permitted to make against Our application programming interface, and, for Services that enable You to provide public websites, on the number of page views by visitors to those websites.

  • Applicable Use Rights For perpetual licenses, the Use Rights in effect when Customer orders a Product will apply. For subscriptions, the Use Rights in effect at the start of each subscription period will apply. Customers with subscriptions for Software may use new versions released during the subscription period subject to the Use Rights in effect when those versions are released. For metered Products billed periodically based on usage, the Use Rights in effect at the start of each billing period will apply during that period. Microsoft may update the Use Rights periodically, but material adverse changes for a particular version will not apply during the applicable license, subscription, or billing period.

  • ACCEPTABLE USE RESTRICTIONS You must:

  • Scope of Limitations and Exclusions The limitation and exclusion in this Section 8 shall not apply: (i) to the extent that liability cannot be limited or excluded according to Applicable Law; (ii) in cases of willful misconduct and gross negligence; (iii) in cases of bodily injuries or death caused by our negligence; and (iv) in cases of fraud or fraudulent misrepresentation. In cases of gross negligence, liability is limited to the amount of foreseeable loss that would have been prevented through the exercise of due care.

  • Storage limitation The data importer shall retain the personal data for no longer than necessary for the purpose(s) for which it is processed. It shall put in place appropriate technical or organisational measures to ensure compliance with this obligation, including erasure or anonymisation2 of the data and all back-ups at the end of the retention period.

  • Notice of Impermissible Use If an impermissible use or disclosure of any University Records occurs, Contractor will provide written notice to University within one (1) business day after Contractor’s discovery of that use or disclosure.   • Leave for Storm Or Hazardous Conditions It is the responsibility of the Nurse to make every reasonable effort to arrive at their work location as scheduled, however, during storm conditions, when such arrival is impossible, or delayed, all absent time will be deemed to be leave, and the Nurse has the option to:

  • Use Limitations Your license is solely for the purposes of creating, presenting, hosting, analyzing, viewing and delivering Events (as defined below) to Authorized Users, subject to any limitation of Seats (as defined below) specified in the Order Form. “Event” means a single live broadcast event transmitted over the SaaS Service created and/or sponsored in whole or substantial part by Customer or Customer’s employees that is branded under Customer’s name. The term “Events” shall include both live and archived Events. “Seat” means each Authorized User served by a stream of digitally encoded data that delivers an Event to such Authorized User in the SaaS Service and shall include an Authorized User’s access to live Events and archived Events but does not include an access to a downloaded archived Event. A limitation on a number of Seats limits the number of unique Authorized Users of the Service.
