Appropriate measures may include providing the required information to the public, for example, on a website, in a precise, transparent, understandable, and easily accessible form, using clear and simple language (Section 33(2), BDSG.). If the data controller retains personal data under BDSG Section 35(1), the data controller must restrict personal data processing under GDPR Article 18. This limitation on the data controller’s obligation to erase certain personal data does not apply if the data controller processed the personal data unlawfully. (Section 35(1), BDSG.) German law does not subject legal entities to criminal sanctions. Only the person committing the act is liable under the German Criminal Code or other penal provisions.
