Phases of Construction. The shell of the New Y2 Facility shall be built in one phase, and the New Y2 Facility cleanroom shall be built in three phases of substantially similar size. ****

Phases of Construction. The Public Improvements serving Lots 1-4 within CSM 14444 shall be constructed in one phase (“Phase One”). The Public Improvements for Phase One are described in the Plans, titled Yahara River Learning Center prepared under the seal of Xxxxx X. Xxxxxx, P.E. of Xxxxxx & Associates, Inc., dated March 28, 2017 (the “Plans”), which are incorporated herein by reference as if fully set forth herein. Construction of Phase One will commence on or about April 24, 2017, and be substantially completed on or about July 1, 2017. These commencement dates and completion dates shall not be changed, except with the prior written consent of Windsor’s Engineer. There are no subsequent phases approved by this Agreement. Additional Public Improvements shall be necessary to serve Lot 5 of CSM 14444 and Xxx 0 xx Xxxxxxxxx Xxxxxx Xxx Xx. 00000 (“CSM 13076”) (collectively, “Additional Properties”). Construction of such additional Public Improvements shall be commenced only following approval of Windsor; and in such event, such additional Public Improvements shall be set forth in a separate Agreement, together with associated exhibits describing the additional Public Improvements. Developer acknowledges that it has no vested rights in subsequent approvals and that Windsor retains full legislative discretion with respect to same, subject to the terms of the existing intergovernmental utility agreement between Windsor and the Village of XxXxxxxx.
