Common use of PHOTOGRAPH RELEASE Clause in Contracts

PHOTOGRAPH RELEASE. You give your permission to us to use any photograph or photographic image taken of you while you are in any public spaces, grounds, offices at NorthPointe Student Apartments or any Community sponsored events in the Community or otherwise. You understand that your photograph or photographic image will be used for nothing other than legitimate business purposes. You hereby grant N Student Apartments, Homestead U and assigns, those acting with its authority and permission, the irrevocable and unrestricted right and permission to copyright, in its own name or otherwise, and use, re-use, publish, and re-publish photographic portraits or pictures of you or in which you may be included, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations, in conjunction with your own or a fictitious name, or reproductions thereof in color or otherwise, made through any medium, and in any and all media now or hereafter known for illustration, promotion, art, editorial, advertising, trade, or any other legal purpose whatsoever. You also consent to the use of any printed matter in conjunction therewith. You hereby waive any right that you may have to inspect or approve the finished product and the advertising copy or other matter that may be used in connection therewith or the use to which it may be applied. You hereby release, discharge, and agree to hold harmless NorthPointe Student Apartments, Homestead U, and all persons acting under its permission or authority from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in taking said picture or in any subsequent processing thereof, as well as any publication forever discharge NorthPointe Student Apartments, Homestead U, and its officers, employees, attorneys, representatives, insurers and assigns from any and all demands, cause of action and/or judgments of whatsoever nature of character, past or future, known or unknown whether in contract or in tort, whether for personal injuries, property damage, payments, fees, expenses, accounts receivable, credit, refunds, or any other monies due or to become due, or damages of any kind or nature, and whether arising from common law or statute, arising out of, in any way, the use of your photograph or photographic image. This release contains the entire agreement on this subject matter between the parties and will be binding upon and inure to the benefit of the successors and assigns of the undersigned.

You hereby grant N Student ApartmentsThe QUAD, Homestead U University Corporation, CSUSM, Capstone On-Campus Management, LLC (the “QUAD Parties”), and their assigns, and those acting with its proper authority and permission, the irrevocable and unrestricted right and permission to copyright, in its own name or otherwise, and use, re-use, publish, and re-publish republish photographic portraits or pictures of you or in which you may be included, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations, in conjunction with your own or a fictitious name, or reproductions thereof in color or otherwise, made through any medium, and in any and all media now or hereafter known for illustration, promotion, art, editorial, advertising, trade, or any other legal purpose whatsoever. You also consent to the use of any printed matter in conjunction therewith. You Licensee hereby waive waives any right that you may have to inspect or approve the finished product and the advertising copy or other matter that may be used in connection therewith or the use to which it may be applied. You Licensee hereby releasereleases, dischargedischarges, and agree agrees to hold harmless NorthPointe Student Apartments, Homestead U, the QUAD Parties and all persons acting under its with proper authority and permission or authority from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in taking said picture or in any subsequent processing thereof, as well as any publication forever discharge NorthPointe Student ApartmentsThe QUAD Parties, Homestead U, and its their officers, employees, attorneys, representatives, insurers and assigns from any and all demands, cause of action and/or judgments of whatsoever nature of character, past or future, known or unknown unknown, whether in contract or in tort, whether for personal injuries, property damage, payments, fees, expenses, accounts receivable, credit, refunds, or any other monies due or to become due, or damages of any kind or nature, and whether arising from common law or statute, arising out of, in any way, the use of your photograph or photographic image. This release contains the entire agreement on this subject matter between the parties and will be binding upon and inure to the benefit of the successors and assigns of the undersigned. On or before March 14th, 2018 If cancellation request and supporting documentation is received by the office on or before March 14th, 2018, Licensee will be charged a $150 cancellation fee. March 15th, 2018 through May 1st, 2018 If cancellation request and supporting documentation is received by the office between March 15th, 2018, and on or before May 1st, 2018, Licensee will be charged a $300 cancellation fee. May 2nd, 2018 through July 1st, 2018 If cancellation request and supporting documentation is received by the office between May 2nd, 2018, and on or before July 1st, 2018, Licensee will be charged a $600 cancellation fee. July 2nd, 2018 through August 24th, 2018. If cancellation request and supporting documentation is received by the office between July 2nd, 2018, and on or before August 24th, 2018, the Licensee will be charged a $1,500 cancellation fee. On or after August 25th, 2018. If termination request and supporting documentation is received by the office on or after August 25th, 2018, Licensee will be charged a termination fee of $3,000 or for any License Fee installments due during the License Term, whichever is less. Please Note: Licensee will not be released from liability due to school withdrawal or transfer, business transfer, loss of job, University or The QUAD conduct sanctions, marriage, divorce, health, roommate conflict or change in admissions status. Except as provided herein, License Fees, late fees, and termination fees still apply in cases where the admission status has changed or Licensee is no longer attending the University.

You understand that your photograph or photographic image will be used for nothing other than legitimate business purposes. You hereby grant N Student Apartments, Homestead U Campus West Apartments and their assigns, those acting with its authority and permission, the irrevocable and unrestricted right and permission to copyright, in its own name or otherwise, and use, re-use, publish, and re-publish republish photographic portraits or pictures of you or in which you may be included, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations, in conjunction with your own or a fictitious name, or reproductions thereof in color or otherwise, made through any medium, and in any and all media now or hereafter known for illustration, promotion, art, editorial, advertising, trade, or any other legal purpose whatsoever. You also consent to the use of any printed matter in conjunction therewith. You hereby waive any right that you may have to inspect or approve the finished product and the advertising copy or other matter that may be used in connection therewith or the use to which it may be applied. You hereby release, discharge, and agree to hold harmless NorthPointe Student ApartmentsCampus West Apartments and EDR Syracuse Campus West, Homestead ULLC and assigns, and all persons acting under its permission or authority from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in taking said picture including video or video stills or in any subsequent processing thereof, as well as in any publication publication. You forever discharge NorthPointe Student ApartmentsCampus West Apartments and EDR Syracuse Campus West, Homestead ULLC, and its officers, employees, attorneys, representatives, insurers and assigns from any and all demands, cause of action and/or judgments of whatsoever nature of or character, past or future, known or unknown unknown, whether in contract or in tort, whether for personal injuries, property damage, payments, fees, expenses, accounts receivable, credit, refunds, or any other monies due or to become due, or damages of any kind or nature, and whether arising from common law or statute, arising out of, in any way, the use of your photograph or photographic image. This release Section contains the entire agreement on this subject matter between the parties and will be binding upon and inure to the benefit of the successors and assigns of the undersigned.

It is agreed that the Community or otherwise. You understand that your use of my photograph or photographic image will shall only be used for nothing other than legitimate business and College purposes. You I hereby grant N Student ApartmentsLicensor, Homestead U and assignsAgent, those the College, or any of their authorized agents or designees acting with its their authority and permissionpermissions, the irrevocable and unrestricted right and permission to copyright, in its own name or otherwise, and use, re-use, publish, and or re-publish photographic portraits or pictures of you me or in which you I may be included, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations, in conjunction with your my own or a fictitious name, or reproductions thereof in color or otherwise, made through any medium, and in any and all media now now, or hereafter known for illustration, promotion, art, editorial, advertising, trade, or any other legal purpose whatsoever. You I also consent to the use of any printed or website matter in conjunction therewith. You I hereby waive any right that you I may have to inspect or approve the finished product and the advertising copy or other matter that may be used in connection therewith or the use to which it may be applied. You I do hereby releaserelease and forever discharge Licensor, dischargeAgent, Queens College, The City University of New York, the Dormitory Authority of the State of New York, the City of New York, and agree to hold harmless NorthPointe Student Apartmentsthe State of New York or any of their authorized agents, Homestead U, and all persons acting under its permission or authority from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in taking said picture or in any subsequent processing thereof, as well as any publication forever discharge NorthPointe Student Apartments, Homestead U, and its officers, employees, attorneys, representatives, insurers and assigns representatives from any and all demands, cause causes of action action, and/or judgments of whatsoever whatever nature of character, past or future, known or unknown unknown, whether in contract or in tort, whether for personal injuries, property damage, payments, fees, expenses, accounts receivable, creditcredits, refunds, or any other monies due or to become due, or damages of any kind or nature, nature and whether arising from common law or statutestatue, arising out of, in any way, the use of your my photograph or photographic image. This release contains the entire agreement on between the parties with respect to this subject matter between the parties hereof and will shall be binding upon and inure to the benefit of the successors and assigns of the undersigned.Licensee and Licensor. You Licensee hereby releasereleases, dischargedischarges, and agree agrees to hold harmless NorthPointe Student Apartments, Homestead U, University Village Parties and all persons acting under its with proper authority and permission or authority from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in taking said picture or in any subsequent processing thereof, as well as any publication forever discharge NorthPointe Student ApartmentsUniversity Village Parties, Homestead U, and its their officers, employees, attorneys, representatives, insurers and assigns from any and all demands, cause of action and/or judgments of whatsoever nature of character, past or future, known or unknown unknown, whether in contract or in tort, whether for personal injuries, property damage, payments, fees, expenses, accounts receivable, credit, refunds, or any other monies due or to become due, or damages of any kind or nature, and whether arising from common law or statute, arising out of, in any way, the use of your photograph or photographic image. This release contains the entire agreement on this subject matter between the parties and will be binding upon and inure to the benefit of the successors and assigns of the undersigned. On or before July 25, 2018 If cancellation request and supporting documentation is received by the office on or before July 25, 2018 Licensee will not be charged a cancellation fee. July 26, 2018 through August 23, 2018 If cancellation request and supporting documentation is received by the office between July 26, 2018, and on or before August 23, 2018, Licensee will be charged a cancellation fee equal to $50 per day from August 23, 2018 to the effective date of cancellation, which is 30 days after receipt. On or after August 24, 2018 with at least 30 days’ notice where request is approved If termination request and supporting documentation is received by the office on or after August 24, 2018 with at least 30 days’ notice, and the request is accepted by Licensor, the Licensee will be charged a cancellation fee based on $50 per day daily rate from August 24, 2018 to the last date of occupancy (or end of the notice period, whichever is longer), or the License Fee, whichever is less. On or after August 24, 2018 where request is not approved If termination request and supporting documentation is received by the office on or after August 24, 2018 (with or without full 30 days’ notice), and the request is not accepted by Licensor, then Licensee shall not be relieved of payment of the full amount of the License Fee. On or after August 24, 2018 with less than 30 days’ notice where request is approved If termination request and supporting documentation is received by the office on or after August 24, 2018 with less than 30 days’ notice, and the request is accepted by Licensor who also waives notice, then Licensee will be charged a daily rate of $50 August 24, 2018 to the last day of occupancy (or end of the notice period, whichever is longer), or the License Fee, whichever is less. Please Note: Licensee will not be released from liability due to school withdrawal or transfer, business transfer, loss of job, University or University Village conduct sanctions, marriage, divorce, health, roommate conflict or change in admissions status without prior approval of Licensor. Except as provided herein, License Fees, late fees, and termination fees still apply in cases where the admission status has changed or Licensee is no longer attending the University.
