Physical Plant Standards. The Facility and the use thereof comply in all material respects with all applicable local, state and federal building codes, fire codes, health care, nursing/assisted living/senior housing facility (as applicable) and other similar regulatory requirements (the “Physical Plant Standards”), and no waivers of Physical Plant Standards exist at the Facility.
Physical Plant Standards. A manager shall ensure that an assisted living center complies with the applicable physical plant health and safety codes and standards, incorporated by reference in A.A.C. R9-1-412, in effect on the date the assisted living facility submitted architectural plans and specifications to the Department for approval.

Each Property and the use thereof complies in all material respects with all applicable local, state and federal building codes, fire codes, life safety codes, health care, nursing facility and other similar regulatory requirements, including, without limitation, participation requirements in Medicare and Medicaid (collectively, the "Physical Plant Standards") and, except as described on the Schedule X attached hereto and attached to the Mortgage Loan Agreement, no waivers of the Physical Plant Standards exist at such Property.
