The provisions of the Association's Master Deed, By-Laws Residential Use Restrictions, and Rules and Regulations ("Governing Documents") constitute material provisions of the lease for this unit (the "Lease”) and are incorporated by reference in this Lease Rider.
The following Sections shall survive any expiration, cancellation, or termina- tion of this Agreement: 1.4 (Use Restrictions), 2.3 (Rights in Customer Data), 2.4 (Indemnification by Customer), 3 (Ownership), 4 (Fees), 6.5 (Limitation Pe- riod), 6.6 (Exclusive Remedy), 7 (Limitation of Liability), 8 (Indemnity; Rights in case of Defects in Title), 9 (Con- fidential Information), 10 (Term and Termination), and 12 (General Terms).
Failure by Tenant to comply with the Governing Documents constitutes a material breach of the Lease and is grounds for eviction in accordance with the Residential Use Restrictions Paragraph (t).
The Developer shall include language in the lease agreement which requires the Tenant to comply with the Use Restrictions.
The Developer shall rent the Project to the Tenant who will use the leased space solely for manufacturing, warehouse, office and/or research and development purposes and space necessary for and related to manufacturing, office, warehousing and/or research and development (the "Use Restrictions").
