Planning Certificates. The Developer acknowledges that Council may, at its discretion, include advice on any planning certificate issued under section 10.7 of the Act that this agreement affects the Land.
Planning Certificates. The Parties agree that the Council may, in its absolute discretion, make a notation under section 149(5) of the Act regarding this Agreement on any certificate issued under section 149(2) of the Act relating to the Land.

The Developer acknowledges that the Council may, in its absolute discretion, make a notation under section 10.7(5) of the Act regarding this Agreement on any certificate issued under section 10.7(2) of the Act relating to the Land, and is not to raise an objection, make any claim or demand or bring any action in that regard.

The Developer [Insert ‘and Landowner’ if applicable] acknowledges that the Council may, in its absolute discretion, make a notation under section 10.7(5) of the Act regarding this Agreement on any certificate issued under section 10.7(2) of the Act relating to the Land, and is not to raise an objection, make any claim or demand or bring any action in that regard. This Deed is governed by the law of New South Wales. The Parties submit to the non-exclusive jurisdiction of its courts and courts of appeal from them. The Parties are not to object to the exercise of jurisdiction by those courts on any basis.
Planning Certificates. East Quarter acknowledges that Council may, pursuant to Section 149(5) of the Act, make a notation regarding the VPA on any certificate issued pursuant to Section 149(2) of the Act in relation to the Land or any other land affected by the VPA.

The Landowner acknowledges that the Council may, at its absolute discretion, make a notation under s10.7(5) of the EPA Act to the effect that the land is subject to the PA on any certificate issued under s10.7 of the EPA Act relating to the land the subject of the agreement.
