Common use of Polygraph Examinations Clause in Contracts

Polygraph Examinations. Command officers may only be ordered to take a polygraph examination by the Chief of Police. The order to take the examination may not be unjust and arbitrary. In any arbitration or Civil Service hearing, relevant evidence that consists of the results of a polygraph examination which has been lawfully carried out by an accredited examiner may be excluded only if determined that the order was unjust and arbitrary. These polygraph examinations will be run by a polygraph operator who is not a member of the Kettering Police Department, unless the officer and the Chief agree to it. When an employee is ordered to submit to a polygraph examination, the information gained cannot be used against the employee in any subsequent criminal proceedings.
