Common use of Polygraph Examinations Clause in Contracts

Polygraph Examinations. A. No employee shall be compelled to submit to a polygraph examination against their will. No disciplinary action or other retaliation shall be taken against an employee who refuses to submit to a polygraph examination, and no comment will be entered anywhere in the investigator’s notes or anywhere else that indicates the employee refused to take a polygraph examination. No testimony or evidence that the employee refused to take a polygraph examination will be admissible at any hearing, trial, or proceeding, whether judicial or administrative. B. An employee who is rejected for a position in the Police Department due to failure of a polygraph examination will be provided with the reason for such failure.
