Common use of Power of the Arbitrator Clause in Contracts

Power of the Arbitrator. It is agreed that the arbitrator is empowered to award only compensatory damages and that the arbitrator shall have no authority to award interest on such damages or attorney’s fees. The arbitrator shall have no power to add to, delete from, amend, ignore, or in any manner alter the existing contract. Neither the Board nor the Association will be permitted to assert any grounds before the arbitrator which was not previously disclosed to the other party prior to the hearing.
