Pregnancy Leave (Applicable to Full. Time and Part Time employees) a) Pregnancy leave will be granted in accordance with the provisions of the Employment Standards Act, except where amended in this provision. The service requirement for eligibility for pregnancy leave shall be thirteen (13) weeks of continuous service. b) The employee shall give written notification at least two (2) weeks in advance of the date of commencement of such leave and the expected date of return. At such time she shall also furnish the Hospital with the certificate of a legally qualified medical practitioner stating the expected birth date. c) The employee shall reconfirm her intention to return to work on the date originally approved in subsection (b) above by written notification received by the Hospital at least two (2) weeks in advance thereof. d) An employee who is on pregnancy leave as provided under this Agreement who has applied for and is in receipt of Employment Insurance pregnancy benefits pursuant to Section 22 of the Employment Insurance Act, shall be paid a supplemental unemployment benefit. That benefit will be equivalent to the difference between ninety-three percent (93%) of her regular weekly earnings and the sum of her weekly Employment Insurance benefits and any other earnings. Such payment shall commence following completion of the two-week Employment Insurance waiting period, and receipt by the Hospital of the employee’s Employment Insurance cheque stub as proof that she is in receipt of Employment Insurance pregnancy benefits, and shall continue while the employee is in receipt of such benefits for a maximum period of fifteen (15) weeks. The employee’s regular weekly earnings shall be determined by multiplying her regular hourly rate on her last day worked prior to the commencement of the leave times her normal weekly hours plus any wage increase or salary increment that she would be entitled to if she were not on pregnancy leave. The Hospital will pay the employee ninety-three percent (93%) of her normal weekly earnings during the first two (2) week period of the leave while waiting to receive Employment Insurance Benefits. The employee does not have any vested right except to receive payments for the covered unemployment period. The plan provides that payment in respect of guaranteed annual remuneration or in respect of deferred remuneration or severance pay benefits are not reduced or increased by payments received under the plan. e) Credits for service and seniority shall accumulate for a period of up to seventeen weeks while an employee is on pregnancy leave. f) The Hospital will continue to pay its share of the contributions of the subsidized employee benefits, including pension, in which the employee is participating for a period of up to seventeen (17) weeks while the employee is on pregnancy leave. g) Subject to any changes to the employee’s status which would have occurred had she not been on pregnancy leave, the employee shall be reinstated to her former duties, on the same shift in the same department, and at the same rate of pay.

The employer agrees to provide a pregnancy leave of up to seventeen weeks (17) for a pregnant employee. It is agreed that the union and the bargaining unit employees shall not be disadvantaged in any way by any amendments to the Ontario Employment Standards Act and Regulations. For greater clarity, the Collective Agreement provisions shall prevail. Where this collective agreement provides an with a greater right, benefit, term or condition for pregnancy leave, that specific or in question in the Agreement shall prevail. In the event the Ontario Employment Standards Act and Regulations are amended to provide a greater right, benefit, term or condition to an with respect to pregnancy and parental leave than that which existed on March each of such amended provisions shall be incorporated within this Collective Agreement. The employee shall give written notification at least two (2) weeks in advance of the date of commencement of such leave and the expected date of return. The Hospital normal weekly hours for a part time employee shall be calculated by using the same time period as used for the calculation of the Employment Insurance benefit. The employee does not have any vested right except to receive payments for the covered unemployment period.
