Preliminary Title Evidence. The term “Preliminary Title Evidence” collectively refers to the preliminary title insurance commitment(s) prepared by Community Title & Escrow, Ltd., applicable to the Purchased Tract(s) and identified on the table attached as Exhibit E (the “Preliminary Commitment Table”). Xxxxx acknowledges and agrees that the Preliminary Title Evidence was made available for review by all prospective bidders, including Buyer, at the Auction site prior to and during bidding and prior to the Auction via download from the auction website.
Preliminary Title Evidence. As used herein, the term “Preliminary Title Evidence” refers to the preliminary title insurance schedules prepared by First American Title Insurance Company, as described in Exhibit B. Buyer acknowledges that the Preliminary Title Evidence has been made available for review by prospective bidders prior to the Auction and also has been made available for review at the Auction site prior to and during bidding.
Preliminary Title Evidence. Xxxxx acknowledges and agrees that Xxxxx has received and reviewed the following documents (collectively, the "Preliminary Title Evidence"): (i) the preliminary title insurance schedules dated August 12, 2019 prepared by the Title Company and referenced as File No. NCS-973757 (the “Preliminary Title Insurance Schedules”); (ii) the survey prepared by Xxxxxxx Engineering & Land Surveying Co., Inc. dated December 23, 2010 showing the perimeter boundary and legal description for the Auction Tracts as a whole unit but not as individual tracts; and (iii) the survey prepared by Norwest Surveying Services dated April 22, 2011 showing the perimeter boundary and legal description for the Auction Tracts as a whole unit but not as individual tracts. Xxxxx acknowledges and agrees that copies of the Preliminary Title Insurance Schedules and the 2010 survey described above have been made available for review by prospective bidders prior to the Auction (in printed form and/or via download from the auction website) and that all of the Preliminary Title Evidence has been made available for review at the Auction site prior to and during bidding. Xxxxx further acknowledges that Xxxxx approves of the Preliminary Title Evidence and agrees to accept title to the Property subject to all matters listed, shown and/or disclosed therein.

Xxxxx further acknowledges that Xxxxx approves of the Preliminary Title Evidence and agrees to accept title to the Property subject to all matters listed, shown and/or disclosed therein (except Liens, if any). “

Buyer acknowledges that the Preliminary Title Evidence has been made available for review by prospective bidders at the Auction site prior to and during bidding. Buyer agrees to acquire the Property at Closing subject to and notwithstanding all matters affecting the Property that are disclosed, identified or listed in the Preliminary Title Evidence (except Liens, if any). “Liens” refers to any mortgage, deed of trust, collateral assignment of rents, judgment lien and/or other monetary obligation attaching as a lien against the Property other than a lien for Taxes not yet due and payable.

Xxxxx acknowledges that preliminary title insurance schedules prepared by American Abstract Company of McClain County, Inc. dated December 31, 2018 (but signed as of January 9, 2019) and identified as File No. 20190035 for the Surface Tracts only (the “Preliminary Title Evidence”) have been made available for review by prospective bidders prior to the Auction (in printed form and/or via download from the auction website) and at the Auction site prior to and during bidding. Xxxxx agrees to acquire the Purchased Surface Tracts and accept the title thereto subject to and notwithstanding all matters (except liens, if any) listed, disclosed or described in the Preliminary Title Evidence, whether or not referring to a recorded instrument.
Preliminary Title Evidence. Preliminary title insurance schedules dated September 30, 2020 and identified by reference to “File No.: 20201699” have been prepared by American Abstract Company of XxXxxxx County, Inc. (“Preliminary Title Evidence”) and posted to the auction website prior to the Auction. Buyer agrees to acquire the Property at Closing subject to and notwithstanding all matters referenced in the Preliminary Title Evidence (except Liens, if any).

If this purchase includes Tract 5 and/or Tract 6: (a) Buyer acknowledges that Preliminary title insurance schedules have been prepared by Community Escrow & Title Co. for Tracts 5 and 6 (the “Preliminary Title Evidence”) and have been made available for review by prospective bidders at the Auction site prior to and during bidding; and (b) Buyer agrees to acquire the Property at Closing subject to and notwithstanding all matters affecting the Property that are disclosed, identified or listed in the Preliminary Title Evidence (except Liens, if any). “Liens” refers to any mortgage, deed of trust, collateral assignment of rents, judgment lien and/or other monetary obligation attaching as a lien against the Property other than a lien for Taxes not yet due and payable.
