Preliminary Title Evidence. The term “Preliminary Title Evidence” collectively refers to the preliminary title insurance commitment(s) prepared by Spears Title Company applicable to the Purchased Tract(s) and identified on the table attached as Exhibit E (the “Preliminary Commitment Table”). Buyer acknowledges and agrees that the Preliminary Title Evidence was made available for review by all prospective bidders, including Buyer, at the Auction site prior to and during bidding and prior to the Auction via download from the auction website.

Preliminary Title Evidence. As used herein, the term “Preliminary Title Evidence” refers to the preliminary title insurance schedules prepared by First American Title Insurance Company, as described in Exhibit B. Buyer acknowledges that the Preliminary Title Evidence has been made available for review by prospective bidders prior to the Auction (in printed form and/or via download from the auction website) and at the Auction site prior to and during bidding. Xxxxx agrees to purchase and acquire the Real Estate subject to and notwithstanding all matters disclosed, depicted, noted, identified or listed in the Preliminary Title Evidence (except Liens, if any). “Liens” refers to any monetary lien(s) affecting the Real Estate other than a lien for current, non-delinquent Taxes.

(The provisions of this Section are subject to the provisions of Section 12 below, if applicable.)

Buyer understands that the tract numbers used to identify various parcels in the Preliminary Title Evidence do not correspond to the tract numbers used in Exhibit A to identify the auction tracts for purposes of the Auction and this Agreement.
