Contractors may use or disclose Medi-Cal PII only to perform functions, acitivities or services directly related to the administration of the Medi-Cal program in accordance with Welfare and Institutions Code section 14100.2 and 42 Code of Federal Regulations section 431.300 et.seq, or as required by law. Disclosures which are required by law, such as a court order, or which are made with the explicit written authorization of the Medi-Cal client, are allowable. Any other use or disclosure of Medi-Cal PII requires the express approval in writing of DHCS. Contractor shall not duplicate, disseminate or disclose Medi-Cal PII except as allowed in the Agreement. B. Access to Medi-Cal PII shall be restricted to only contractor personnel who need the Medi-Cal Pii to perform their official duties in connection with the administration of the Medi-Cal program. C. Contractor and/or their personnel who access, disclose or use Medi-Cal PII in a manner or for a purpose not authorized by this Agreement may be subject to civil and criminal sanctions contained in applicable Federal and State statutes.
Privacy and Personal Information We respect Your privacy and will only use and disclose Your personal information in accordance with the Australian Privacy Principles as set out in the Privacy Act 1988 (Cth) and in accordance with Our Privacy Policy. In particular We will keep Your information confidential unless: a) We have Your prior written consent; or b) the Law (including any regulatory, accounting, governmental, Ministerial or stock exchange requirement) requires or permits Us to disclose certain information; or c) We need to use the information for Our regulatory reporting or compliance, or in any legal or regulatory proceedings; or d) the information is already in the public domain; or e) We believe You have used electricity illegally and, as a result, We provide relevant information to the Economic Regulation Authority or the Director of Energy Safety; or f) We use the information for business purposes. g) You have not paid Your electricity bill, and We disclose information to a credit reporting agency, but We will not provide information about a default to a credit reporting agency if: (i) You have made a complaint in good faith about the default and the complaint has not been resolved; or (ii) You have requested Us to review Your electricity bill and the review is not yet completed. To ensure your information remains confidential, we will: 1) Provide Our staff with training around Australian Privacy Principles to ensure Your privacy is maintained; 2) Maintain up to date protection software for all electronically stored information; 3) Where possible, hold Your information on Our internal company network to minimise the risk of an electronic breach, or alternatively use secure, encrypted data centres; 4) Protect all of Our electronic data which contains Your information with passwords. The availability of these passwords will only be provided to staff that require access to the information for ongoing operational purposes; 5) Request that any third parties who require access to Your information provide assurances that they will comply with the Privacy Act; 6) Once no longer required for Our business or compliance purposes, We will destroy Your information as soon as practicable. TEACHERS AND RESEARCHERS 1. An individual who is a resident of a Contracting State immediately before making a visit to the other Contracting State, and who, at the invitation of any university, college, school or other similar educational institution, visits that other State for a period not exceeding two years solely for the purpose of teaching or research or both at such educational institution shall be exempt from tax in that other State on any remuneration for such teaching or research. 2. This Article shall not apply to income from research if such research is undertaken primarily for the private benefit of a specific person or persons.

Safe and Respectful Workplace 69.1 The Parties recognise that everyone is entitled to work in an environment that is free of discrimination, harassment and bullying. It is the Employer’s responsibility to ensure it complies with relevant legislative requirements including the Equal Opportunity Act 2010 (Vic). 69.2 Accordingly, the Parties agree to the Sexual Harassment principles and the Respect Code in Appendix J. 69.3 In accordance with those principles the following points will be covered in the Employer’s on site induction: (a) It is everyone’s responsibility to respect women’s right to work without having to experience unacceptable behaviour. (b) Disrespectful actions and behaviours which express power inequalities between women and men and cause physical, sexual, psychological or economic harm to women are unacceptable on site. (c) Unacceptable behaviours that women face in the workplace include: (i) stalking and intimidation; (ii) threats and verbal abuse; (iii) ostracism; (iv) rude gestures and put downs; (v) offensive language and imagery; (vi) sexual innuendo / insinuations; (vii) sexual suggestions and/or unwanted advances; and (viii) sexual assault. (d) These behaviours at work present serious OHS risks which may cause significant physical and psychological injury. (e) This respect must also be extended to other visitors to the site and members of the public.

Confidential Information and Restricted Activities Employee has entered into the Company’s Employee Proprietary Information Agreement (“EPIA”) and acknowledges his or her obligations thereunder. The EPIA is specifically incorporated into this Agreement.
CONFIDENTIALITY AND PRIVACY POLICIES AND LAWS The Contractor shall comply to the extent applicable with all State and Authorized User policies regarding compliance with various confidentiality and privacy laws, rules and regulations, including but not limited to the IRS Publication 1075, Family Educational Rights and Privacy Act (FERPA), the Health Insurance and Portability Act of 1996 (HIPAA) and the Health Information Technology for Economic and Clinical Health Act (HITECH). Contractor shall cooperate in executing a written confidentiality agreement under FERPA and/or a Business Associate Agreement (HIPAA/HITECH) or other contractual provisions upon request by the State or any Authorized User.
