Privity. 34.1 This Agreement is intended solely for the benefit of the Parties and is not intended to confer any benefits on, or create any rights in favour of any other person.

Privity. 16.1 Until final completion of the Project, the Subcontractor agrees not to perform any work directly for the Owner or any tenants thereof, or deal directly with the Owner's representatives in connection with the Project, unless otherwise directed in writing by the Contractor. All Work for this Project performed by the Subcontractor shall be processed and handled exclusively through the Contractor.

Privity. Wherever this Agreement is expressed as conferring rights on one or more Spark Affiliates, those rights will be enforceable by each Spark Affiliate under Part 2, Subpart 1 of the Contract and Commercial Law Act 2017, provided that those Spark Affiliates will not be entitled to bring proceedings against Supplier except with Xxxxx’s written consent. Where a Spark Affiliate enters into an Agreement with Supplier, only the Spark Affiliate incurs any obligation or liability to Supplier with respect to that Agreement. Dispute resolution
Privity. This Agreement is not intended to confer any benefit on or create any obligation enforceable at the suit of any person not a party to this Agreement, except where this Agreement expressly provides otherwise.
Privity. A person who is not a Party will not have any rights under or in connection with this Agreement by virtue of the Contracts (Privity) Xxx 0000 except under clauses 16.1 and 16.2 which confer a benefit on, and are intended to be enforceable by those person named in those clauses.

The relationship established between TULIP and XXXX shall be solely that of seller and buyer, and neither party shall be in any way the agent or representative of the other party for any purpose whatsoever, and shall have no right to create or assume any obligation or responsibility of any kind, whether express or implied, in the name of or on behalf of the of the party to bind the other party in any manner whatsoever.
