Final Completion of the Project. If, at Final Completion of the Project, the Final Actual Cost (including reconciliation of allowances) is less than the Target Cost, then the ICL is increased by 50% of the difference. If after reconciliation of allowances the Final Actual Cost exceeds the Target Cost, then the ICL will be reduced, dollar for dollar, by the amount of the difference. If, after this reduction, the amount of ICL that had previously been distributed at Milestones exceeds the reduced ICL, then the Prime Consultant and General Contractor will, within 15 days of Project Final Completion, repay Owner the amount of the overpayment, in proportion to their ICL Percentages.
Final Completion of the Project. When Design-Builder believes that Final Completion of the entire Project has been achieved, it shall notify Owner’s Representative in writing and request an inspection for certification of Final Completion of the Project. Design- Builder shall thereafter meet on site with Owner’s Representative to determine whether Final Completion of the Project has in fact been achieved. Design-Builder’s request for such inspection shall constitute a representation by Design-Builder to Owner that Design-Builder has made all inspections of the Work as provided in the contract and that, to the best of Design- Builder’s knowledge and belief, all the Work has been completed in compliance with the Contract Documents and that the quality of the Work meets or exceeds the requirements of the Contract Documents. If Owner’s Representative agrees that Final Completion of the Project has been achieved, Owner shall execute a Certificate of Final Completion of the Project. If Owner’s Representative, upon inspection, concludes that Final Completion has not been achieved from the fault of the Design-Builder, Subcontractors, and/or any agents thereof and that re-inspection will be necessary, Design-Builder shall bear all costs of same without adjustment to the Guaranteed Maximum Price.
Final Completion of the Project. When all Punch-List Items have been completed, ESCO shall issue a Final Completion Letter informing Owner that the applicable Work is ready for inspection and shall provide an invoice for the outstanding balance of the Project Price along with a conditional release of all liens arising out of the Contract. Within thirty (30) days of receiving the Final Completion Letter, Owner shall execute an acknowledgment stating that Final Completion has been Version: January 2024 achieved as of the date set forth therein (the “Project Completion Date”). Notwithstanding anything to the contrary contained herein, if the Owner fails to issue said acknowledgement, or fails to provide in writing a justifiable basis for denying the achievement of Final Completion within said thirty (30) days, then the Project Completion Date shall be the 31st day from the date the Owner received the Final Completion Letter.
Final Completion of the Project. Final Completion of the Project may be achieved hereunder pursuant to Section 6.7.1 below.
Final Completion of the Project. Final Completion of the Project shall occur when the Architect determines that
(1) the entire Project and all of its systems, including access to the Project and any off-site work required by the Contract Documents, are sufficiently complete and cleaned in accordance with the Contract Documents, (2) the required Certificates of Occupancy and other governmental approvals have been obtained, and (3) the Architect issues the Certificate of Final Completion. In order for the Construction Manager to have achieved Final Completion of the Project, the Architect must have determined that the Owner is able to occupy the Project and all of the site and utilize all building systems per the Contract Documents. The Project must also be properly cleaned as set out above (See Section 3.
Final Completion of the Project. For all purposes of this Agreement, the Date of Project Final Completion is the Date of Section Final Completion as stated in the Section Final Certificate of the last Section to receive such certification under this Agreement.
Final Completion of the Project. The delivery by the Bills to the ECSC and the County of a written certification from the Architect establishing that the Project is completed and that all Punch List Items and Corrective Work have been fully and completely performed in accordance with the Plans and Specifications.
Final Completion of the Project. When all Punch-List Items have been completed, ESCO shall inform Customer that the applicable Work is ready for inspection and shall provide an invoice for the outstanding balance of the Contract Price along with a conditional release of all liens arising out of the Contract. Promptly following Customer’s receipt thereof, the parties shall conduct a final walk-through and, upon confirming at the walk-through that all of the agreed Punch-List Items have been completed, Customer shall execute an acknowledgment stating that Final Completion has been achieved as of the date set forth therein (the “Project Completion Date”).
