PROBLEMS CORRECTED. If the foregoing problems are corrected, payment shall be made to the Contractor for the amounts withheld, but the City shall not be liable to the Contractor for Interest on any delayed payment. The Manager shall not exercise the City's right to withhold payments under this Section 45 unless the Manager concludes that such action is reasonable and necessary in light of the Contractor's repeated problems or persistent failure to perform in compliance with the requirement s herein.
