Common use of Procedure to Determine Bid Compliance Clause in Contracts

Procedure to Determine Bid Compliance. A bid may be rejected as non-responsive if it fails to submit one or more of the following with its bid demonstrating its Good Faith Efforts to meet the Contract Specific Goals by reaching out to MBEs and WBEs to perform work on the contract: • An MBE/WBE compliance plan demonstrating how the bidder plans to meet the Contract Specific Goals; and/or • A request for reduction or waiver of the Contract Specific Goals in accordance with Section 2-92-450 of the MCC. Only compliance plans utilizing MBE and WBE firms that meet BOTH the Commercially Useful Function and Area of Specialty requirements will be counted toward the Contract Specific Goals. The following Schedules and described documents constitute the bidder's MBE/WBE proposal, and must be submitted in accordance with the guidelines stated:
