Product Markings. NEWLINK shall xxxx all Licensed Products (or their containers or labels) made, sold, or otherwise disposed of by NEWLINK, its Affiliates or Sublicensees, under the license granted in this Agreement, in accordance with all applicable United States and foreign statutes pertaining to the marking of products with patent pending, patent number(s), copyrights, or other intellectual property notices and legends required to maintain the intellectual property rights licensed in this Agreement.

Unless otherwise stated in the item’s specifications, all products for delivery shall have markings indicating date of manufacturer and/or expiration date clearly marked on the individual package. Shelf-stable products at the time of delivery must have a minimum of 75% shelf-life remaining.
Product Markings. 13.1 Vendor shall clearly xxxx on the packaging of each unit Product the Product's name and computer compatibility. Such packaging shall also bear a machine-readable bar code identifier scannable in standard ABCD format which identifies the Product and its serial number.

Product Markings. All Products delivered or sold to the Distributor(s) or AFC shall bear whatever trademarks, trade names, logos or other identifying markings (the "Markings") as AFC shall prescribe. Supplier shall use or affix the Markings only on Products which are delivered or sold to the Distributor(s) or AFC. AFC shall provide the form of all Markings to Supplier and Supplier shall affix such Markings precisely in the place(s) on each of the Products as AFC shall designate. Supplier shall bear all costs of affixing such Markings and of all artwork, printing plates or any other miscellaneous items which are required as part of the production process of the Products.

(a) Buyer hereby grants to Supplier a non-exclusive, non-transferable, worldwide, royalty-free, fully paid up license during the Term to use Buyer Marks solely for purposes of labeling the Products and for no other purpose. Supplier acknowledges and agrees that Bxxxx will be advertising, marketing and selling the Products under Bxxxx’s Marks. Any and all goodwill arising from the use of any Buyer’s Marks will inure solely to the benefit of Buyer.
(b) Neither Supplier nor any of its affiliates will assert any claim to any Buyer’s Marks (or any confusingly similar mark) or such goodwill either during or after the Term or attempt to register any such mark. Without limiting the generality of the foregoing, Supplier shall not use any service marks or trademarks of Buyer, or any word, title, expression, trademark, design or marking that is confusingly similar thereto, as part of its corporate or business name or in any other manner whatsoever and shall not register any trade mark or trade name (including any Buyer name) which is identical to or confusingly similar to or incorporates the service marks or trademarks of Buyer or any of its affiliates.
(c) Buyer represents and warrants that any logos, marks or names, including the Buyer’s Marks, that it provides to Supplier will not infringe or violate any trademark, copyright or other proprietary right of any person not a party to this Agreement.
