Product Requirements. Provide 2 copies of catalogs sheets, brochures, diagrams, schedules, performance charts, illustrations of materials, assemblies, systems specified, MSDS sheets (where applicable), and other standard descriptive data. Assemble in a loose-leaf binder with tabs for each specification section, and update when a change occurs. Physical material samples of specified materials shall be furnished to the DCAMM upon request.
Product Requirements. The Products and all components and ingredients thereof shall be produced in strict accordance with: (a) current Good Manufacturing Practices (as defined in regulations promulgated by the Food and Drug Administration ("FDA") under the U.S. Food, Drug and Cosmetic Act, as amended (the "Act"), and as generally understood and interpreted by the pharmaceutical industry) ("cGMPs"), and (b) quality control procedures and associated test methods for the manufacturing process as developed by JSP. Each of LCI and JSP warrant and guarantee to the other that each article shipped by them under this Agreement: (i) will not, on the date of shipment, be adulterated or misbranded (A) within the meaning of the Act, or (B) within the meaning of any applicable state law in which the definitions of "adulteration" and "misbranding" are substantially the same as those contained in the Act, as such laws are constituted and effective at the time of such shipment or delivery and (ii) will not be an article which may not under the provisions of Section 404 or 505 of the Act be introduced into interstate commerce. Products may only be shipped if the package configuration is in compliance with the cGMPs and FDA regulations.

Unless otherwise indicated, all items specified on the Contract Pricelist which are listed on the OEM or Contractor-Published Pricelist as standard or optional equipment for a Product provided under the Contract shall be factory installed and operative. Product delivered to an Authorized User in a condition considered to be below retail customer acceptance levels will not be accepted. Items which determine this acceptance level shall include, but not be limited to, the general appearance of the interior and exterior of the Chassis Cab, Truck Body or Upfitted Truck for completeness and quality of workmanship, lubrication and fluid levels, with any leaks corrected, mechanical operation of the vehicle and all electrical components operational. Product specified to be furnished and installed which is not available through the OEM shall conform to the best quality standards known to that particular industry, both product and installation.

Product Requirements. The product for which private labeling is requested must be completely identical to and shall not differ from the Client’s product that has achieved certification under these Service Terms.
Product Requirements. Each Product you submit to Microsoft for publication and distribution through the Stores must meet the following requirements:
Product Requirements. 5.1 All products provided by you must be provided in a condition ready to be photographed and must be clean and undamaged.
5.2 For fashion products, all products must be the same size as agreed between us in writing before we commence the Services.
5.3 Any product/s missing from a product manifest provided by you or any products with existing damage upon our receipt of said products, will be reported to you when observed.
5.4 Any excessive remedial work including steaming, ironing, assembly, or Photoshop that is required to correct poor product condition or work to accommodate variability in size will be charged in our Invoice. The fees for this work are set out on the Site or in our quote provided to you before we commence the Services.
5.5 You will be made aware of any additional costs in respect of clause 5.4 of this Agreement before we provide the Services to you.
5.6 To the best of our endeavours, we will return the product in the same condition as received, excluding replacement in product packaging, with any repackaging or postage costs payable by you as set out in our Invoice.
5.7 All product transit costs incurred by us will be passed on to you at the rate of charge of the carrier plus 20% and will be set out in our Invoice.
5.8 You may advise us of your preferred carrier before we provide the Services to you.
5.9 For any Content that we have provided to you as part of the Services, you acknowledge and agree that we reserve the right to retain any products provided to us by you to develop the Content, until you make full payment of our Invoices.

Such specifications and ----------- procedures may not be modified, changed or added to without prior written notification to Marketer ("Product Change Notification"). Any subsequent or replacement versions of Products listed on Exhibit 1.20 developed and ------------ manufactured by Manufacturer may be added to the Products marketed and distributed by Marketer under the general terms and conditions of this Agreement.
