Production Handling Option. The basic terms of production handling agreements will not be a part of this Agreement but the Parties agree that it is the general intention of the Parties to independently and in good faith evaluate the use of existing, nearby sole ownership facilities of Chevron, if any and where appropriate, for the handling of Prospect production from successful Prospect wells; however, neither party is committed to bring its share of Prospect production to a Party's nearby sole ownership facility or to accept production at a Party's nearby sole ownership facility. The Parties will negotiate any such use in good faith, where the Parties see mutual benefit to such use; however, the use of an Existing Facility, or near by facility, will require the consent of both Parties to all terms and condition of such use prior to such use.

Production Handling Option. Texaco, as an accommodation to McMoRan, will consider handling production resulting from any well drilled by McMoRan on any acreage farmed out or subleased at Texaco's facilities (if excess capacity exists) located in the vicinity of any acreage earned by McMoRan pursuant to any Farmout Agreement or Sublease. McMoRan will have the option to enter into an agreement with Texaco to handle its production attributable to any Prospects earned by paying reasonable and customary fees for the services provided. A production handling agreement will be negotiated by the Parties in the event one is needed and if the Parties mutually agree to pursue Texaco handling McMoRan's production.

  • Delivery Points The measurement of and tests for quality of Shipper's Gas redelivered at the Delivery Points shall be governed by and determined in accordance with the requirements of the receiving pipeline at each Delivery Point.

  • Delivery Point Once Manufacture of the Products has been completed, Contractor shall be responsible for delivering the Finished Goods FCA, (as defined in Incoterms (2000) published by the International Chamber of Commerce) and to a freight forwarder specified by Company in its Order, or otherwise approved by Company. “Delivery Point” as used in this Agreement shall mean the specific time and location that the Product is delivered to the shipper specified on the Order.

  • Storage Any storage space at any time leased to Tenant hereunder shall be used exclusively for storage. Notwithstanding any other provision of this Lease to the contrary, (i) Landlord shall have no obligation to provide heating, cleaning, water or air conditioning therefor, and (ii) Landlord shall be obligated to provide to such storage space only such electricity as will, in Landlord’s judgment, be adequate to light said space as storage space.

  • Production Work Except as agreed to in writing by the Parties pursuant to the "Production Work" section of the Standard Online Commerce Terms & Conditions attached hereto as Exhibit F, MP will be responsible for all production work associated with the Affiliated MP Site, including all related costs and expenses.

  • Plant An electrical generating alternative energy resource facility developed by Producer for which IID shall provide transmission service, as specified in Exhibit(s) II, Transmission Service, and in any subsequent Plant Amendments.

  • Floor Loading Floor loading capacity shall be within building design capacity. Tenant may exceed floor loading capacity with Landlord’s consent, at Landlord’s sole discretion and must, at Tenant’s sole cost and expense, reinforce the floor as required for such excess loading.

  • Interconnection If Manager desires to interconnect a portion of the Service Area Network with another carrier and Sprint PCS can interconnect with that carrier at a lower rate, then to the extent permitted by applicable laws, tariffs and contracts, Sprint PCS may arrange for the interconnection under its agreements with the carrier and if it does so, Sprint PCS will xxxx the interconnection fees to Manager.
