Programming Authority. The Grantee shall have no authority or control over any programming cablecast on channels dedicated to the CAC pursuant to Section 19.1 of this Agreement. All programming cablecast on such channels shall not be considered origination cablecasting for purposes of Grantee's compliance with Section 76 Subpart G of the FCC rules and regulations unless otherwise determined by the FCC with respect to the Grantee. The Grantee shall have no responsibility under Section 4-280-260(D) of the Cable Ordinance for programming cablecast on any CAC dedicated channels. Nothing in Section 19 of this Agreement shall be construed to imply that Grantee is a common carrier.
