Common use of PROGRAMMING EXCLUSIVITY AND NON-COMPETITION Clause in Contracts

PROGRAMMING EXCLUSIVITY AND NON-COMPETITION. The Town agrees that it will not use its designated PEG Access channels, equipment, or other facilities to provide for-profit commercial services which have the effect of competing with the Licensee’s telecommunications business. In addition, any programming produced under the provisions of this Article 6 shall not be commercially distributed to a competing Multichannel Video Programming Distributor without the consent of the Licensee.

The Town City agrees that it will not use its designated PEG Access channels, equipment, or other facilities to provide for-profit commercial services which have the effect of competing with the Licensee’s telecommunications cable business. In addition, any programming produced under the provisions of this Article 6 shall not be commercially distributed to a competing Multichannel Video Programming Distributor without the consent of the Licensee, however Access programming produced under this license may be made available to another Multichannel Programming Distributor.
