Project Organisation. 3.1.1 The proposed project organisation and lines of communication with respect to environmental protection works are shown in Appendix C. 3.1.2 The leader of the ET shall be an independent party from the Contractor and has relevant professional qualifications, and have at least 7 years of experience in conducting EM&A projects subject to approval of the Engineer’s Representative (ER), Independent Environmental Checker (IEC) and EPD. 3.1.3 The responsibilities of respective parties are: 3.1.3.1 The Contractor  employ an Environmental Team (ET) to undertake monitoring, laboratory analysis and reporting of environmental monitoring and audit;  provide assistance to ET in carrying out monitoring and auditing;  submit proposals on mitigation measures in case of exceedances of Action and Limit levels in accordance with the Event and Action Plans;  implement measures to reduce impact where Action and Limit levels are exceeded; and  adhere to the agreed procedures for carrying out complaint investigation. 3.1.3.2 Environmental Team (ET)  set up all the required environmental monitoring stations;  monitor various environmental parameters as required in the Contract Specific EM&A Manual;  analyse the environmental monitoring and audit data and review the success of EM&A programme to cost-effectively confirm the adequacy of mitigation measures implemented and the validity of the EIA predictions and to identify any adverse environmental impacts arising;  carry out site inspection to investigate and audit the Contractors' site practice, equipment and work methodologies with respect to pollution control and environmental mitigation, and take proactive actions to pre-empt problems;  audit and prepare audit reports on the environmental monitoring data and site environmental conditions;  report on the environmental monitoring and audit results to the IEC, Contractor, the ER and EPD or its delegated representative;  recommend suitable mitigation measures to the Contractor in the case of exceedance of Action and Limit levels in accordance with the Event and Action Plans; and  undertake regular on-site audits/inspections and report to the Contractor and the ER of any potential non-compliance; and  follow up and close out non-compliance actions. 3.1.3.3 Engineer or Engineer’s Representative (ER)  supervise the Contractor’s activities and ensure that the requirements in the Contract Specific EM&A Manual are fully complied with;  inform the Contractor when action is required to reduce impacts in accordance with the Event and Action Plans;  employ an IEC to audit the results of the EM&A works carried out by the ET; and  comply with the agreed Event Contingency Plan in the event of any exceedance. 3.1.3.4 Independent Environmental Checker (IEC)  review the EM&A works performed by the ET (at not less than monthly intervals);  audit the monitoring activities and results (at not less than monthly intervals);  report the audit results to the ER and EPD in parallel;  review the EM&A reports (monthly and quarterly summary reports) submitted by the ET;  review the proposal on mitigation measures submitted by the Contractor in accordance with the Event and Action Plans;  check the mitigation measures that have been recommended in the EIA and this Manual, and ensure they are properly implemented in a timely manner, when necessary; and  report the findings of site inspections and other environmental performance reviews to ER and EPD. 3.1.3.5 Environmental Protection Office (ENPO) Notwithstanding the above, given that the Tuen Mun - Chek Lap Kok Link (TMCLKL), HKBCF and HKLR will be constructed concurrently, an Environmental Protection Office (ENPO) or equivalent to oversee the cumulative construction projects in North Lantau area will be established by the Project Proponent. The responsibility of the ENPO would be similar to that of the IEC but should also include:  coordinate the monitoring and auditing works for all the on-going projects in the area in order to identify possible sources/causes of exceedances and recommend suitable remedial actions where appropriate;  review cumulative impacts including possible sources/causes of exceedance and recommending suitable remedial actions;  liaise with the mainland project teams for HZMB Main Section to identify and assess any cross-boundary cumulative impacts in order to establish suitable remedial actions where necessary; and  coordinate the assessment and response to complaints/enquires from locals, green groups, district councils or the public at large. The exact responsibilities and organisation of the ENPO have been defined by the Project Proponent in accordance with the relevant Environmental Permits.

The Contractor  employ an Environmental Team (ET) to undertake monitoring, laboratory analysis will: • work within the scope of the construction contract and reporting of environmental monitoring and auditother tender conditions; provide assistance to the ET in carrying out monitoring and auditingmonitoring; submit proposals on mitigation measures in case of exceedances of Action and Limit levels in accordance with the Event and Action Plans; implement measures to reduce impact where Action and Limit levels are exceeded; • implement the corrective actions instructed by ER/ET/IEC; • participate in the site inspections undertaken by the ET and the IEC, as required, and undertake any corrective actions instructed by ER/ET/IEC; and • adhere to the agreed procedures for carrying out complaint investigation. 3.1.3.2 Environmental Team (ET)  set up all the required environmental monitoring stations;  . The ET will be led and managed by the ET Leader. The ET leader will have relevant education, training, knowledge, experience and professional qualifications and the ER appointment will be subject to the approval of any potential non-compliance; the Director of Environmental Protection and  follow up and close out non-compliance actions. 3.1.3.3 Engineer or Engineer’s Representative (ER)  supervise the Contractor’s activities and ensure that the requirements . Suitably qualified staff will be included in the Contract Specific EM&A Manual are fully complied with;  inform ET, and the ET should not be in any way an associated body of the Contractor when action is required to reduce impacts in accordance with or the Event and Action Plans;  employ an IEC to audit the results of the EM&A works carried out by the ET; and  comply with the agreed Event Contingency Plan in the event of any exceedance. 3.1.3.4 Independent Environmental Checker (IEC) for the Project. The IEC will: • review and monitor the implementation of the EM&A works performed programme and the overall level of environmental performance being achieved; • arrange and conduct monthly independent site inspections/audits of the works; • validate and confirm the accuracy of monitoring results, monitoring equipment, monitoring stations, monitoring procedures and locations of sensitive receivers; • carry out random sample check and audit on monitoring data and sampling procedures, etc; • audit the EIA recommendations and requirements against the status of implementation of environmental protection measures on site; • on needed basis, audit the Contractor(s)’s construction methodology and agree the appropriate, reduced impact alternative in consultation with ER, the ET and the Contractor; • provide specialist advice to ER and the Contractor on environmental matters; • check complaint cases and the effectiveness of corrective measures; • check that the necessary mitigation measures recommended in the EIA, EP and Contract documents, or as subsequently required, are effectively implemented; • review EM&A report submitted by the ET (at not less than monthly intervals);  audit the monitoring activities leader and results (at not less than monthly intervals);  report the feedback audit results to the ER and EPD in parallelET by signing off relevant EM&A proformas;  review the EM&A reports (monthly and quarterly summary reports) submitted by the ET;  review the proposal on mitigation measures submitted by the Contractor in accordance with the Event and Action Plans;  check the mitigation measures that have been recommended in the EIA and this Manual, and ensure they are properly implemented in a timely manner, when necessary; and  report the findings of site inspections inspections/ audits and other environmental performance reviews to ER ER, ET, EPD and EPD. 3.1.3.5 Environmental Protection Office (ENPO) Notwithstanding the above, given that the Tuen Mun - Chek Lap Kok Link (TMCLKLContractor(s), HKBCF ; and HKLR Sufficient and suitably qualified professional and technical staff will be constructed concurrently, an Environmental Protection Office (ENPO) or equivalent to oversee the cumulative construction projects in North Lantau area will be established employed by the Project Proponent. The Independent Checker (Environmental) and EPD shall keep this logbook readily available for inspection. 3.4 Sufficient and suitably qualified professional and technical staff shall be employed by the respective parties to identify any adverse environmental impacts arising;  carry out ensure full compliance with their duties and responsibility, as required under the EM&A programme for the duration of the Project. The broad categories of works of the ET comprise the following: 1. Sampling, analysis and statistical evaluation of monitoring parameters with reference to the EIA study recommendations and requirements; 2. Environmental site inspection to investigate surveillance; 3. Inspection and audit of compliance with environmental protection, and pollution prevention and control regulations; 4. Inspection and audit of compliance with procedures established to enable an effective response to environmental incidents, exceedances or non-compliance; 5. Assess the Contractors' site practice, equipment effectiveness of the environmental mitigation measures implemented; 6. Monitor the implementation of environmental mitigation measures; 7. Monitor compliance with the environmental protection clauses/specifications in the Contract; 8. Review the construction schedule and provide comments as necessary; 9. Review work methodologies which may affect the extent of environmental impact during the construction phase and comment as necessary; 10. Complaint investigation, evaluation and identification of corrective measures; 11. Liaison with respect to pollution control and the Project Independent Checker (Environmental) on all environmental mitigationperformance matters, and take proactive actions to pre-empt problems;  audit and prepare audit reports on timely submission of all relevant EM&A proforma for approval of the environmental monitoring data and site environmental conditions;  report on the environmental monitoring and audit results to the IEC, Contractor, the ER and EPD or its delegated representative;  recommend suitable mitigation measures Independent Checker (Environmental); 12. Advice to the Contractor in on environmental improvement, awareness, enhancement matters, etc., on site; and 13. Timely submission of the case EM&A report to the Project Proponent and the EPD. 3.5 In the event of any exceedance of Action / Limit levels, the ET shall inform the Independent Checker (Environmental), Engineer’s Representative and Limit levels the Contractor within one working day (Monday to Friday except public holidays). The ET shall also advise of any change in accordance circumstances or any non-compliance with the Event and Action Plans; and  undertake regular on-site audits/inspections and report EIA study so that appropriate remedial actions may be taken promptly by the Contractor. 3.6 The ET is also responsible for the preparation of the monthly EM&A reports for submission to Independent Checker (Environmental), the Contractor and the ER Engineer’s Representative, and through the Engineer’s Representative, to EPD. The ET shall assist the Contractor and the Engineer’s Representative in formulating any necessary corrective actions and/or additional mitigation measures, and liaising with relevant Government Departments where necessary. 3.7 The IC(E) shall be responsible for the duties defined in this EM&A Manual. The IC(E) shall audit the overall EM&A programme including the implementation of all environmental mitigation measures, submissions relating to EM&A, and any other submissions required in this EM&A Manual. The IC(E) shall also be responsible for verifying the environmental acceptability of permanent and temporary works, relevant design plans and submissions referred under this Manual. 3.8 The IC(E) shall verify the log-book prepared and kept by the ET Leader. The IC(E) shall notify EPD, within 24 hours of receipt of notification from the ET Leader of any potential non-compliance; and  follow up and close out such instance or circumstance or change of circumstances or non-compliance actionswith the EIA study, which might affect the monitoring or control of adverse environmental impact. 3.1.3.3 Engineer or Engineer’s Representative (ER3.9 The main duty of the IC(E)  supervise is to carry out independent environmental audit of the Contractor’s activities Project. This shall include, inter alias, the following: 1. Review and ensure that the requirements audit in the Contract Specific EM&A Manual are fully complied with;  inform the Contractor when action is required to reduce impacts an independent, objective and professional manner in accordance with the Event and Action Plans;  employ an IEC to audit the results all aspects of the EM&A works carried programme; 2. Validate and confirm the accuracy of monitoring results, appropriateness of monitoring equipment, monitoring locations with reference to the locations of the nearby sensitive receivers, and monitoring procedures; 3. Carry out by random sample check and audit on monitoring data and sampling procedures, etc; 4. Conduct random site inspection (at least once a month); 5. Audit the ET; EIA study recommendations and  comply requirements against the status of implementation of environmental protection measures on site; 6. Review the effectiveness of environmental mitigation measures and project environmental performance; 7. On an as needed basis, verify and certify the environmental acceptability of the construction methodology (both temporary and permanent works), relevant design plans and submissions under the environmental permit. Where necessary, the IC(E) shall agree in consultation with the agreed Event Contingency Plan in ET Leader and the event Contractor the least impact alternative; 8. Verify investigation results of any exceedance.complaint cases and the effectiveness of corrective measures; 3.1.3.4 Independent Environmental Checker (IEC)  review the 9. The Contractor should report to the ER. The duties and responsibilities of the Contractor are: ▪ Design and implement environmental controls and mitigation measures as set out in the EP, EIA Report, EM&A Manual and other government’s standards; ▪ Participate in site inspections undertaken by the ET; ▪ Provide assistance to ET to carry out monitoring; ▪ Provide requested information to the ET in the event of any exceedance. 3.1.3.4 Independent Environmental Checker exceedance in the environmental criteria (IECAction/Limit levels)  review the EM&A works performed by the ET (at not less than monthly intervals)as specified in this Manual or other current environmental standards and to rectify unacceptable practices;  audit the monitoring activities and results (at not less than monthly intervals);  report the audit results to the ER and EPD in parallel;  review the EM&A reports (monthly and quarterly summary reports) submitted by the ET;  review the proposal ▪ Submit proposals on mitigation measures submitted by in case of exceedance in the Contractor environmental criteria (Action/Limit levels), in accordance with the Event and Action PlansPlans as specified in this Manual;  check and ▪ Co-operate with the ET in providing all the necessary information and assistance for completion of the complaint investigation works. The duties and responsibilities of the ET are: ▪ Sampling, analysis and statistical evaluation of monitoring parameters with reference to the EIA study recommendations and requirements; ▪ Environmental site surveillance; ▪ Inspection and audit of compliance with environmental protection, and pollution prevention and control regulations; ▪ Assess the effectiveness of the environmental mitigation measures implemented; ▪ Review work methodologies which may affect the extent of environmental impact during the construction phase and comment as necessary; ▪ Complaint investigation, evaluation and identification of corrective measures; ▪ Liaison with the IEC on all environmental performance matters, and timely submission of all relevant Environmental PermitsEM&A proforma for IEC’s approval; and ▪ Advice to the Contractor on environmental improvement, awareness and enhancement matters, etc. The IEC should advise the ET and ER on environmental issues related to the project. The IEC should audit from an independent viewpoint on the environmental performance during the construction of the project. The IEC should be a person who has relevant professional qualifications in environmental control and at least 7 years experience in EM&A and environmental management. The duties and responsibilities of the IEC are: ▪ Review and audit in an independent, objective and professional manner in all aspects of the EM&A programme; ▪ Validate and confirm the accuracy of monitoring results, appropriateness of monitoring equipment, monitoring locations with reference to the locations of the nearby sensitive receivers, and monitoring procedures; ▪ Carry out random sample check and audit on monitoring data and sampling procedures, etc; ▪ Conduct random site inspection; ▪ Audit the EIA recommendations and EP requirements against the status of implementation of environmental protection measures on site; ▪ Review the effectiveness of environmental mitigation measures and project environmental performance; ▪ On an as-need basis, verify and certify the environmental acceptability of the construction methodology (both temporary and permanent works), relevant design plans and submissions under the environmental permit. Where necessary, the IEC should agree in consultation with the ET and the Contractor the least impact alternative; ▪ Check complaint cases and the effectiveness of corrective measures; ▪ Verify EM&A report certified by the ET Leader; and ▪ Feedback audit results to the ER/ET according to the Event/Action Plans specified in this EM&A Manual.
