Common use of Proof of service Clause in Contracts

Proof of service. In proving service of any notice it will be sufficient to prove, in the case of a letter, that such letter was properly stamped or franked first class, addressed and placed in the post or, in the case of personal delivery, when left at the correct address and, in the case of a facsimile transmission, that such facsimile was duly transmitted to the facsimile number of the addressee referred to in Clause 9.1 above.

Proof of service. In proving service of any notice or other communication it will be sufficient to prove, : (i) in the case of a letter, that such letter was properly stamped or franked first classfranked, addressed and placed in the post or, or in the case of personal delivery, when was left at the correct address address; and, (ii) in the case of a facsimile fax transmission, that such facsimile fax was duly transmitted to the facsimile number fax number, as appropriate, of the addressee referred to in Clause 9.1 aboveparagraph (a).
