Impairment of Service. The characteristics and methods of operation of any circuits, facilities or equipment of SPRINT connected with the services, facilities or equipment of VERIZON pursuant to this Agreement shall not interfere with or impair service over any facilities of VERIZON, its Affiliated companies, or its connecting and concurring carriers involved in its services, cause damage to its plant, violate any applicable law or regulation regarding the invasion of privacy of any communications carried over VERIZON’s facilities or create hazards to the employees of VERIZON or to the public (each hereinafter referred to as an "Impairment of Service"). If SPRINT causes an Impairment in Service, VERIZON shall promptly notify SPRINT of the nature and location of the problem and that, unless promptly rectified, a temporary discontinuance of the use of any circuit, facility or equipment may be required. VERIZON and SPRINT agree to work together to attempt to promptly resolve the Impairment of Service. If the SPRINT is unable to promptly remedy the Impairment of Service, then VERIZON may at its option temporarily discontinue the use of the affected circuit, facility or equipment.

If there is an impairment of service, the provisions in the Interconnection Attachment, section 7.5 shall apply.

Impairment of Service. 12.1 As far as IBExpert is obliged to deliver new program versions to the Customer, the warranty provisions in case of defectiveness, listed under section X. of the Standard Business Terms Software Lease apply in the case of defectiveness of these software programs.
12.2 For the services provided under the first‐level support consulting and support services IBExpert shall be liable for the punctual and proper implementation, but not for economic or other performance success aims of the Customer.
Impairment of Service. CLEC’s use of any CenturyLink UNE, or of its own equipment or facilities in conjunction with any CenturyLink UNE, will not materially interfere with, impair service, or artificially increase CenturyLink’s transport or switching load beyond the intended capacity of the obtained UNE on any facilities of CenturyLink, its Affiliated companies or its connecting and concurring carriers involved in its services, cause damage to their plant, impair the privacy of any communications carried over their facilities or create hazards to the employees of any of them or the public. Upon reasonable written notice and opportunity to cure, CenturyLink may discontinue **CLEC’s offending service or refuse service if **CLEC violates this provision. 78.20. Performance of Unbundled Network Elements.
78.20.1. Upon **CLEC’s specific request, CenturyLink shall provide **CLEC technical information about CenturyLink’s network facilities sufficient to facilitate **CLEC’s access to UNEs consistent with the requirements of Applicable Law and this Agreement.
78.20.2. Nothing in this Agreement will limit either Party’s ability to modify its network through the incorporation of new equipment, new software or otherwise. Each Party will provide the other Party written notice of any such upgrades in its network which could reasonably be expected to materially impact the other Party’s service consistent with the timelines and guidelines established by 47 C.F.R. §§ 51.325-335. **CLEC will be solely responsible, at its own expense, for the overall design of its Telecommunications Services and for any redesign or rearrangement of its Telecommunications Services which may be required because of changes in facilities, operations or procedure of CenturyLink, minimum network protection criteria, or operating or maintenance characteristics of the facilities.

Charter’s use of any CenturyTel NID, or of its own equipment or facilities in conjunction with any CenturyTel NID, will not materially interfere with or impair service over any facilities of CenturyTel, its Affiliated companies or its connecting and concurring carriers involved in its services, cause damage to their plant, impair the privacy of any communications carried over their facilities or create hazards to the employees of any of them or the public. Upon reasonable written notice and opportunity to cure, CenturyTel may discontinue Charter’s offending service or refuse service if Charter violates this provision.

If CCI causes an Impairment in Service, GTE shall promptly notify CCI of the nature and location of the problem and that, unless promptly rectified, a temporary discontinuance of the use of any circuit, facility or equipment may be required. GTE and CCI agree to work together to attempt to promptly resolve the Impairment of Service. If the CCI is unable to promptly remedy the Impairment of Service, then GTE may at its option temporarily discontinue the use of the affected circuit, facility or equipment.
