The "Proper Remedy" clause defines the specific actions or relief that a party is entitled to if the other party breaches the contract. In practice, this clause outlines what constitutes an appropriate response to a violation, such as monetary damages, specific performance, or other corrective measures, depending on the nature of the breach. By clearly stating the remedies available, this clause helps ensure that both parties understand the consequences of non-compliance and provides a predetermined path for resolving disputes, thereby reducing uncertainty and potential litigation.
PROPER REMEDY. Where a grievance is filed and it is determined that an error has been made, the remedy will only be extended to the individual(s) whose rights under the Collective Agreement have been violated. It is understood that in these cases, the actual grievor may not be the recipient of that remedy.
