Common use of PROPERTY IMPROVEMENTS Clause in Contracts

PROPERTY IMPROVEMENTS. There are no proceedings pending, or, to the best of either Borrower’s knowledge, threatened, to acquire through the exercise of any power of condemnation, eminent domain or similar proceeding any part of the Property, the Improvements or any interest therein, or to enjoin or similarly prevent or restrict the use of the Property or the operation of the Facility in any manner. None of the Improvements is subject to any unrepaired casualty or other damage.

There are no proceedings pending, pending or, to the best of either Borrower’s 's knowledge, threatened, threatened in writing to acquire through the exercise of any power of condemnation, eminent domain or similar proceeding proceedings any part of the Property, the Improvements or any interest therein, or to enjoin or similarly prevent or restrict the use of the Property or the operation of any of the Facility in any material manner. None of the Improvements is subject to any unrepaired casualty or other damage.
