Common use of Protection of the Environment Clause in Contracts

Protection of the Environment. The Contractor shall take all reasonable steps to protect the environment (both on and off the Site) and to limit damage and nuisance to people and property resulting from pollution, noise and other results of his operations. The Contractor shall ensure that emissions, surface discharges and effluent from the Contractor’s activities shall not exceed the values stated in the Specification or prescribed by applicable Laws. The Contractor shall (a) establish an operational system for managing environmental impacts (b) carry out all of the monitoring and mitigation measures set forth in the Environmental Impact Assessment and Prepare updated Environmental Management Plan (EMP) including the action plan and checklist. The Contractor shall allocate the budget required to ensure that such measures are carried out and submit quarterly/semi-annual reports on carrying out of such measures to the Authority. More particularly, the Contractor shall comply with (i) the measures and requirements set forth in the environmental management plan attached here to as Appendix A11 of Volume III ; and (ii) any corrective or preventive actions set out in safeguards monitoring reports that the Authority will prepare from time to time to monitor implementation of the Environmental Management Plan. The Contractor shall allocate a budget for compliance with these measures, requirements and actions.
