Provision of Mark-ups. The Parties agree to respond within fifteen (15) days to any request from the other Party for a mark-up of municipal infrastructure or Equipment design drawings showing the location of any portion of the municipal infrastructure or Equipment, as the case may be, located within the portion of the ROWs shown on the plans (the “Mark- ups”), and shall provide such accurate and detailed information as may be reasonably required by the requesting Party.

Provision of Mark-ups. The Parties agree to respond within fifteen (15) days to any request from the other Party for a mark-up of municipal infrastructure or Equipment design drawings showing the location of any portion of the municipal infrastructure or Equipment, as the case may be, located within the portion of the ROWs shown on the plans (the “Mark-ups”), and shall provide such accurate and detailed information as may be reasonably required by the requesting Party. The locates provided by the Company to the Municipality for pre-design shall contain sufficient design information and survey detail as required by the General Manager of Operations, such as line and elevation of the equipment within the right of way, but excluding information on depth. If the Company is unable to provide either line or elevation information within an agreeable timeframe, the Municipality may invoice the Company for any costs reasonably incurred by the Municipality in determining the line or elevation of the Equipment within the right of way. The Company shall remit payment for these costs to the Municipality upon receipt of these invoices.

  • Service Provision Subject to, and in accordance with, the terms and conditions in this Agreement, the Operator will provide the Services (either directly or by making its facilities and services available to other Physicians) to:

  • No Implied Waiver of Breach The waiver of any breach of a specific provision of this Agreement does not constitute a waiver of any other breach of that term or any other term of this Agreement.
