Common use of Public Works Clause in Contracts

Public Works. If OWNER is required by this Agreement to construct any public works facilities which will be dedicated to COUNTY or any other public agency upon completion, and if required by applicable laws to do so, OWNER shall perform such work in the same manner and subject to the same requirements as would be applicable to COUNTY or such other public agency if it would have undertaken such construction.

Public Works. If OWNER is required by this Agreement to construct any public works facilities which will be dedicated to COUNTY CITY or any other public agency upon completion, and if required by applicable laws to do so, OWNER shall perform such work in the same manner and subject to the same requirements as would be applicable to COUNTY CITY or such other public agency if should it would have undertaken such construction.
